county police bureau. Any person violating this subsection shall be
guilty of a misdemeanor and, upon conviction before a [trial magis-
trate] district court or the circuit court for the county, shall be pun-
ished by a fine not to exceed the sum of fifty dollars.
Section 10. Be it further enacted, that Section 3-25 of said
Code, title and article is hereby repealed and a new section 3-25 is
hereby enacted in lieu thereof, all to read as follows:
Section 3-25. Vicious, chasing or barking dogs.
(a) If any person shall make complaint to the dog warden in
his district, or to the dog license commission, that any dog within his
jurisdiction is a menace by reason of vicious disposition or a nuisance
or hazard as evidenced by chasing persons, draft animals, vehicles or
by such whining or barking as to constitute an annoyance to persons
residing in the neighborhood. Such dog warden shall investigate the
complaint and may issue an "Order of [Complaint] Compliance";
provided, however, that the owner may apply in writing to the dog
license commission within ten days thereafter for review of said or-
der. At the hearing thereof, the commission may make such order as
it may deem necessary. Any time within ten days after such order,
the owner or keeper of such dog may bring a petition in the circuit
court for the county praying that the order may be reviewed by the
court, and after such notice to the dog license commission and such
other officer involved as the court may deem necessary, the court
shall review such action, hear the witnesses and affirm such order
unless it shall appear that it was made without proper cause or in bad
faith, in which case such order shall be reversed with costs against
the petitioner. The decision of the circuit court shall be final and con-
clusive upon the parties. If no application for review is filed with the
commission within said period, the order shall become final, after
which the warden may issue a summons or warrant to the owner of
the dog.
(b) If any person owning or harboring such a dog who shall
fail to comply with any order of the dog warden, dog license commis-
sion or the Circuit Court for the County, as the case may be, shall
upon conviction before a district court of the county be punished by a
fine of not more than fifty dollars or by imprisonment for not more
than thirty days, or both.
Section 11. And be it further enacted, that this Act shall take
effect forty-five days after its enactment.
