2508                               County Local Laws

the Department of Public Works require a performance bond or
other security in an amount greater than the reasonable cost of com-
pletion of all required improvements as such reasonable costs shall
be estimated by the Department of Public Works, TAKING INTO
ACCOUNT POTENTIAL COST ESCALATION. No Public Works
Agreement, in the event of default thereof by developer, shall provide
for forfeiture of the security, nor for damages greater than the cost

and overhead reasonably necessary to be incurred by Anne Arundel
County in completing the
uncompleted portion of the work subsequent
to and arising out of such default.
SUCH PUBLIC WORKS AGREE-
MENT, IN THE EVENT OF DEFAULT THEREOF BY DE-
VELOPER, MAY PROVIDE THAT THE SURETY COMPANY
SHALL, WITHIN SIXTY (60) THIRTY (30) DAYS OF WRIT-
TEN NOTIFICATION FROM ANNE ARUNDEL COUNTY OF
SUCH DEFAULT, ELECT TO COMPLETE THE UNCOM-
PLETED PORTION OF THE WORK WITHIN SUCH REASON-
ABLE PERIOD OF TIME AS PRESCRIBED BY ANNE ARUN-
DEL COUNTY OR, FAILING TO SO ELECT, SHALL FORTH-
WITH PAY THE PENALTY OF THE BOND TO ANNE ARUN-
DEL COUNTY IN COMPLETE DISCHARGE OF THE SURETY'S
OBLIGATION THEREUNDER, ANY DELAY IN SUCH PAY-
MENT BEARING INTEREST AT THE RATE OF EIGHT PER
CENT (8%) PER ANNUM; BUT IN NO EVENT SHALL
SUCH PUBLIC WORKS AGREEMENT HEREAFTER ENTERED
INTO PROVIDE OTHERWISE FOR FORFEITURE OF THE
PENALTY OF SUCH BOND. GENERAL INSPECTION FEES,
AS DETERMINED
BY THE DEPARTMENT OF PUBLIC
WORKS SHALL BE REQUIRED TO BE
DEPOSITED WITH
THE COUNTY.
General inspection fees, as determined by the De-
partment of Public Works, shall be required to be deposited with
the County.

Section 2. And be it further enacted, That this Ordinance shall
take effect forty-five (45) days from the date it becomes law.

AN ORDINANCE to repeal Section 1-216 of the Anne Arundel
County Code (1967 Edition and Supplements), Title 1, "Adminis-
tration", Subtitle 2, "Personnel", Article II, "Classified Service",
and to enact new Section 1-216 in lieu thereof, to stand in the
place of the section repealed, increasing the compensation of cer-
tain County employees.

Section 1. Be it enacted by the County Council of Anne Arundel
County, Maryland,
That Section 1-216 of the Anne Arundel County
Code (1967 Edition and Supplements), Title 1, "Administration",
Subtitle 2, "Personnel", Article II, "Classified Service", be, and it is
hereby repealed, and that new Section 1-216 be, and it is hereby
enacted to stand in the place of the section repealed, to read as follows:
