AN ORDINANCE to add new Sections 13-320 through 13-323.3, in-
clusive, to the Anne Arundel County Code (1967 Edition and Sup-
plements), Title 13, "Planning and Zoning", Subtitle 3, "Zoning",
Article VI, "Special Districts" (as enacted by Bill No. 38-70),
under the new heading, "Maritime Group Districts", to follow
immediately .after Section 13-319 thereof, providing for Maritime
Group Districts; setting forth the manner in which said districts
may be used, and the standards and limitations thereof; providing
for the adoption of zoning maps; authorizing the renumbering of
such sections of this Ordinance as may be necessary or desirable
when additional sections of this Subtitle are adopted; providing
that this Ordinance shall become effective only when the entire
Subtitle is adopted and becomes effective and the existing Zoning
laws are repealed; and matters generally related thereto.
Whereas, the Charter of Anne Arundel County, Maryland, pro-
vides that the life of a bill is ninety-five (95) days; and
Whereas, it is impractical and unrealistic to attempt to have
intelligent and meaningful public hearings on a complete Zoning
Ordinance within said ninety-five (95) day period, it is the intent
of the County Council of Anne Arundel County, Maryland, to adopt
Subtitle 3, "Zoning", in sections, no section becoming effective until
the complete subtitle is adopted and becomes effective.
Section 1. Be it enacted by the County Council of Anne Arundel
County, Maryland, That new Sections 13-320 through 13-323.3, in-
clusive, be and they are hereby added to the Anne Arundel County
Code (1967 Edition and Supplements), Title 13, "Planning and Zon-
ing", Subtitle 3, "Zoning", Article VI, "Special Districts" (as enacted
by Bill No. 38-70), to be under the new heading, "Maritime Group
Districts", to follow immediately after Section 13-319 thereof and
to read as follows:
General Provisions
Section 13-320. In General.
(a) Facilities shall be located on water suitable for boating
activities, and shall not violate such water quality control standards
as may be established by the State of Maryland.
(b) The channel within the facilities shall have a sufficient
width to allow side by side passage for two (2) boats of the maximum
size expected to utilize said facilities, plus a minimum clearance of
ten feet (10') between boats. Water depth shall be maintained at
not less than two feet (2') below the draft of the largest boat
expected to use any slip or mooring, at mean low tide.
(c) The location of marina facilities shall not interfere with
existing roads and FIXED bridges, water recreational areas, or com-
mercial fishing areas.
(d) Road network to and within the site shall provide unob-
structed access for emergency equipment.
