LAWS OF ANNE ARUNDEL COUNTY

Bill No. 141-70

AN ORDINANCE to repeal Sections 12-109.2 13-109.4 through
13-109.6, inclusive, of the Anne Arundel County Code (1967 Edi-
tion and Supplements), Title 13, "Planning and Zoning", Subtitle
1. "Subdivisions", Article II, "Subdivision Design and Require-
ments", and to add new Sections 12-2000 through 12-2039, inclusive,
to said Code, Title 12, "Licenses, Permits and Inspections", to
follow immediately after Section 12-1922 thereof, and to be under
the new Subtitle 20, "Grading and Sediment Control", to establish
standards for grading and sediment control; to provide for permits,
fees, bond requirements, basic design policy, inspection and enforce-
ment thereof; AUTHORIZING THE RENUMBERING OF SUCH
SECTIONS OF THIS ORDINANCE AS MAY BE NECESSARY
OR DESIRABLE; and matters generally related thereto.

Section 1. Be it enacted by the County Council of Anne Arundel
County, Maryland,
That Sections 13-109.2 13-109.4 through 13-109.6,
inclusive, of the Anne Arundel County Code, (1967 Edition and
Supplements), Title 13, "Planning and Zoning", Subtitle 1, "Sub-
divisions", Article II, "Subdivision Design and Requirements", be
and they are hereby repealed.

Section 2. And be it further enacted, That new Sections 12-2000
through 12-2039, inclusive, be and they are hereby added to said
Code, Title 12, "Licenses, Permits and Inspections", to follow immedi-
ately after Section 12-1922 thereof and to be under the new Subtitle 20,
"Grading and Sediment Control", and to read as follows:

Subtitle 20, "Grading and Sediment Control"

Article I General Provisions
Section 12-2000. IN GENERAL.

(a)    The purpose of this Subtitle is to safeguard life, limb,
property and public welfare by establishing minimum requirements
for the stripping, excavating and filling of land; and for control of
soil erosion and sediment.

(b)    The provisions of this Subtitle are minimum require-
ments; shall be in addition to (and not in lieu of) any other legal re-
quirements; and shall be liberally construed to accomplish the purposes
hereinabove set forth.

(c)    For purposes of this Subtitle, the below listed terms shall
be defined as follows:

(1) "Acceptable Outfall" means the Tidewater or that point
(as determined by the Department of Public Works) at which storm
water can be released to a channel without causing scouring, erosion,
or resulting sedimentation to the receiving channel or its flood plain.
Where necessary, the outlet shall include structural and vegetative
measures to assure non-erosive velocities.
