2298                                Municipal Charters

[There shall be two commissioners elected from the Third District as
follows :]

Third District: The Third District shall comprise all that area begin-
ning at a point in the centerline of the B. & 0. Railroad where the Eastern
Town Boundary crosses same, thence in a Northerly direction along said
Eastern boundary to the Northernmost Town Boundary thence in a West-
erly direction by and with the Northern Town Boundary to a point where
same intersects the Eastern bank of the Susquehanna River, thence in a
Southerly direction along said Eastern Bank of the Susquehanna River
to the beginning point of the First District, said point being the centerline
of the B. & 0. Railroad, thence in an Easterly direction along the centerline
of the B. & 0. Railroad to the point of beginning, said area to be repre-
sented by two commissioners residing in the area.

In the event no person shall file for commissioners to represent a cer-
tain district or should the number of candidates from any one district
be less than that required to be elected for said district, then in that
event, any person desiring to be elected as a commissioner, regardless
of which district they reside may file for such vacancy to represent that
district within ten days after the closing date for nominations.

Section 2. And be it further resolved by the Commissioners of Per-
ryville, Town of Perryville, that Subsection I of Section 292 of the Code of
Public Local Laws of Cecil County, 1961, as amended, said section being
a part of the Charter of the Town of Perryville, be, and the same is hereby
repealed and re-enacted with amendments to read as follows:

I. Election of Commissioners

Commencing in 1972, on the second Tuesday in May of each year, the
qualified voters of the Town shall elect [five] three persons as Commis-
sioners to serve for a term of [one] two years, in accordance with con-
ditions hereinbefore and/or hereinafter contained.

Section 3. And be it further resolved that the date of adoption of
this Resolution is 2-2-71, and the [reenactment and] amendments to the
Charter of the Commissioners of Perryville, Town of Perryville, hereby
enacted shall become effective on 3-24-71, unless a proper petition for a
referendum herein shall be filed as permitted by law, provided that a com-
plete and exact copy of this Resolution shall be posted in the Town Hall of
Perryville until 3-14-71, and provided, further, that a fair summary of
this Resolution shall be published in a newspaper of general circulation in
the Town of Perryville, once in each of the weeks of 2-10-71, 2-17-71, 2-24-
71, and 3-3-71.

Section 4. And be it further resolved that the President of the Com-
missioners of Perryville, be and he is hereby specifically enjoined and in-
structed to carry out the provisions of Section 3 hereof and as evidence of
said compliance the President of the Commissioners of Perryville shall
cause to be affixed to the minutes of this meeting appropriate certificates
of publication of the newspaper in which the fair summary of this Resolu-
tion shall have been published and shall declare the Charter amendment
hereby enacted to be effected by affixing his signature hereto in the space
provided on the effective date hereof.

Section 5. And be it further resolved that as soon as the Charter
amendments hereby enacted shall become effective either as herein pro-
