Wicomico County

A Proposed Charter Amendment
Entitled

A Resolution and Ordinance to repeal and re-enact, with amend-
ments, Section 36 of Article 23 of the Code of Public Local Laws of
Wicomico County (1965 Edition), title "Delmar," sub-title "Section
36. Commissioners: Qualifications," relating to the number of com-
missioners, the election and the length of the term.

Section 1. BE IT RESOLVED AND ORDAINED by the Commis-
sioners of Delmar, by virtue of the authority granted in Article 11-E of
the Constitution of Maryland, that Section 36 of Article 23 of the Code
of Public Local Laws of Wicomico County (1965 Edition), title "Delmar,"
sub-title "Commissioners; qualifications," be and the same is hereby re-
pealed and re-enacted with amendments, as follows:

36. Commissioners; qualifications.

The government of the said town shall be vested in five Commission-
ers to be elected as hereinafter provided, who shall be taxpayers and
qualified registered voters of the town for twelve months next preced-
ing their election, and shall hold office for a term of four years, except
as hereinafter provided, or until their successor or successors are ap-
pointed or elected and qualified, provided that three [of the] Commis-
sioners SHALL BE elected at the first election held under this section,
[which three shall be determined by lot at the first regular meeting of
the Commissioners of Delmar,] THE TWO RECEIVING THE HIGHEST
NUMBER OF VOTES TO SERVE FOR A TERM OF FOUR YEARS AND
THE ONE RECEIVING THE THIRD HIGHEST NUMBER OF VOTES
shall hold [their] office for a term of two years only; and provided that
at every subsequent election of Commissioners under this section, three
Commissioners shall be elected, [two of whom shall hold office for a term
of four years, and one of whom shall hold office for the term of two
years as aforesaid shall be determined by lot at the first regular meeting
of the Commissioners of Delmar after the said election.] THE TWO RE-
CEIVING THE HIGHEST NUMBER OF VOTES AT SAID ELECTION
SHALL SERVE FOR A TERM OF FOUR YEARS AND THE ONE RE-
CEIVING THE THIRD HIGHEST NUMBER OF VOTES SHALL SERVE
FOR A TERM OF TWO YEARS.

Section 2. AND BE IT FURTHER RESOLVED AND ORDAINED

by the Commissioners of Delmar that this Charter Amendment shall take
effect fifty days from the date of the passage thereof.
