Re: House Bill 305 and Senate Bill 89
Dear Governor Mandel:

We have reviewed the above two bills and although it is our
conclusion that both bills are individually legally sufficient, we wish
to bring to your attention the apparent conflict between them.

Both bills are apparently intended to correct a technical error
in Section 19 of Article 51, relating to juries. The existing law is
ambiguous and possibly contradictory in that subsection (i) provides
for jurors in Dorchester County to receive $15.00 per day and pro-
hibits any extra allowances for expenses while subsection (j) pro-
vides that jurors in Dorchester County shall receive $10.00 per
day and provides nothing as to reimbursement for expenses. Both
bills purport to reconcile these provisions and require payment of
$15.00 per day. Senate Bill 89 does so by amending subsection (j)
and deleting the reference to Dorchester County in subsection (i),
while House Bill 305 deletes subsection (j) entirely and leaves the
reference to Dorchester County in subsection (i). The effect of enact-
ing both bills may well be to remove all reference to payment of
jurors in Dorchester County from Section 19 of Article 51.

Insofar as both bills purport to reach the same result, it would
appear that the proper resolution of this problem, assuming your
concurrence in the substantive effect of the amendment, is to veto
one of the bills and sign the other.

Code of Maryland (1966 Replacement Volume and 1971 Supplement),
title "Comptroller," to follow immediately after Section 26A thereof
and to be under the new subtitle "State Premium Savings Certifi-
cates," and to all ADD new Section 371A to Article 27 of the
Code (1971 Replacement Volume), title "Crimes and Punishments,"
