(3) To repair such malfunctioning or defective consumer product,
or replace it if repair is not commercially practicable or cannot be
timely made;
(4) Within a reasonable period of time, and
(5) Without charge.
(b) If a guarantor is unable to complete guaranty work FUL-
FILL THE TERMS OF THE GUARANTY within ten days of the
tender or delivery of a consumer product to the guarantor, the
guarantor shall provide, upon request of the person guaranteed, a
brief written explanation of the reasons for such delay.
(c) The duties prescribed in this section extend from the guar-
antor to any subsequent person who can show that the guaranty is
extended to him for the duration of the guaranty period stated,
or if no guaranty period is stated, for a reasonable time.
170. Defenses Available to Guarantors
The duties prescribed in Section 169 shall not be imposed upon
any guarantor if the guarantor can show that while the consumer
product was in the possession of the person guaranteed ANY PER-
SON OTHER THAN THE GUARANTOR, damage or unreasonable
use, including failure to provide reasonable and necessary mainte-
nance, caused such product to malfunction or become defective.
171. Disclosure Requirements
Whenever a guaranty is made, the guarantor shall deliver to the
first person guaranteed the following information in writing:
(a) The duration of the guaranty period measured either by time,
law, rule, regulation, or where practical, by some measure of usage
such as mileage;
(b) Any reasonable and necessary maintenance required as a con-
dition for the performance of the guaranty;
(c) The cost of such maintenance if required to be performed
by a designated representative of the guarantor;
(d) (C) A recital of the guarantor's obligations to the person
guaranteed during the guaranty period;
(e) (D) The step-by-step procedure which the person guaranteed
should take in order to obtain the repair or replacement of the mal-
functioning or defective consumer product, and
(f) (E) The means, if any, established by the guarantor for
quick informal settlement of any guaranty dispute.
172. Service Contracts
Nothing in this Act shall be construed to prevent a guarantor
from selling a service contract covering parts or labor or both, to
the person guaranteed at the time of the sale, or at any other time,
in addition to or in lieu of a guaranty.
173. Designation of Representatives
Nothing in this Act shall be construed to prevent a guarantor
from designating representatives to perform the duties required of
