Supplement), title "Crimes and Punishment," subtitle "Trespass," to
follow immediately after Section 578A 578 thereof, and to read as
follows:

578B 578A.

(a)    "Off-road vehicle" is defined in this Section as any motor-
ized vehicle designed for or capable of cross-country travel on or
immediately over land, water, snow, ice, marsh, swampland or other
natural terrain and includes, but is not limited to, four-wheel-drive
or low-pressure-tire vehicles, motorcycles and related two-wheel ve-
hicles, amphibious machines, ground-effect or air-cushion vehicles and
snowmobiles; such terms shall not include any boat, military, fire or
law enforcement vehicle, farm-type tractors and other agricultural
equipment used for agricultural purposes or earth moving or con-
struction equipment while used for such purposes, lawn mowers,
snowblowers, garden or lawn tractors or golf carts while being used
for their designed purpose.

(b)    It is unlawful for any person to operate or use an off-road
vehicle on private property without permission of the owner or tenant
of the property,, or to use an off-road vehicle in the pursuit of wildlife.
Any person convicted of such offense shall be guilty of a misde-
meanor and subject to a fine of up to one thousand dollars ($1,000.00)
and/or imprisonment for a period up to three (3) years
TWO HUN-
DRED AND FIFTY DOLLARS ($250.00).

Sec. 2. And be it further enacted by the General Assembly of
Maryland,
That a new Section 5C 5B be and it is hereby added to
Article 66C of the Annotated Code of Maryland (1970 Replacement
Volume, 1971 Supplement), title "Natural Resources," subtitle "In
General," to follow immediately after Section 5B 5A thereof, and to
read as follows:

5C 5B.

The Secretary of Natural Resources shall promulgate regulations
regarding the operation of off-road vehicles as defined in Section 578B
578A of Article 27 of this Code on property owned or under the con-
trol of the Department of Natural Resources, AND THE SECRE-
TARY SHALL, ON OR BEFORE JANUARY 1, 1973, DESIGNATE
AND PROPERLY IDENTIFY ADEQUATE AREAS FOR USE
BY THE GENERAL PUBLIC FOR OPERATION OF SNOWMO-
BILES ON THE PROPERTY HERETOFORE DEFINED. viola-
tion VIOLATION of such regulations to
SHALL include a penalty
of a fine of up to one thousand dollars ($1,000.00) and/or imprison-
ment for a period of up to three (3)
years TWO HUNDRED AND
FIFTY DOLLARS ($250.00). HOWEVER, OFF-ROAD VEHICLES
SHALL NOT BE PERMITTED WHERE THEIR OPERATION
WILL DAMAGE THE WILDLAND CHARACTER OF THE PROP-
ERTY NOR WHERE THE NOISE FROM THEIR OPERATION
WILL BE AUDIBLE TO PICNIC OR CAMPING AREAS OPEN TO
PUBLIC USE.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1972.
