Sec. 8. And be it further enacted, That this Act shall take effect
July 1, 1972.

CHAPTER 687
(House Bill 25)

AN ACT to repeal and re-enact, with amendments, Section 71 of
Article 89B of the Annotated Code of Maryland (1969 Replace-
ment Volume), title "State Roads," subtitle "Duties and Powers,"
to require the State Highway Administration to pay the cost of
installing and maintaining traffic signals on State roads within
the limits of municipal corporations UNDER CERTAIN CON-
DITIONS, TO PERMIT THE ISSUANCE OF RULES AND
REGULATIONS GOVERNING INSTALLATION AND MAIN-
TENANCE OF TRAFFIC SIGNALS PREDOMINANTLY
SERVING PRIVATE DEVELOPMENTS and to correct errors
therein.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 71 of Article 89B of the Annotated Code of Maryland
(1969 Replacement Volume), title "State Roads," subtitle "Duties
and Powers," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:

71.

The State [Roads Commission] Highway Administration shall
erect and maintain, out of the receipts of its office, along the rights-of-
way of the State roads, the necessary signs, signals or markers for
the purpose of directing the traveling public, warning them of danger,
or for any other purpose which in the opinion of the [Commission]
Administration may be right or proper; and any person who removes,
damages or defaces any such signs, notices or markers shall be guilty
of a misdemeanor and fined a sum not to exceed one hundred
($100.00) dollars. The Administration shall assume the full cost
of installing and maintaining traffic signals when required on any
State roads located AT THE INTERSECTION OF ANY STATE
ROAD AND MUNICIPAL ROAD OR AT SUCH OTHER LOCA-
TION ALONG ANY STATE ROAD within the limits of municipal
corporations in the State as this term is defined in Section 9 of
Article 23A of this Code as amended from time to time. THIS RE-
QUIREMENT SHALL NOT APPLY, HOWEVER, WHEN IN-
STALLATION AND MAINTENANCE OF A TRAFFIC SIGNAL
WILL WHOLLY OR PREDOMINANTLY SERVE TRAFFIC
GENERATED BY PRIVATE DEVELOPMENTS INCLUDING
BUT NOT LIMITED TO APARTMENTS, SHOPPING CENTERS,
