"Public Recreation on Private Lands"; and to add new Sections
410Q and 410R to said Article, of said Code, title, subtitle and sub-
heading, to include horseback riding or HORSE driving, OPER-
ATING MOTORIZED RECREATIONAL VEHICLES and various
educational purposes, within the activities covered by the law which
limits the liability of landowners; allowing owners to post their
property and to grant permission to enter said property; requiring
the Secretary of Natural Resources to distribute permission cards
which limit the liability of the landowner, and generally relat-
ing thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 410J, 410K, 410L, 410M, 410N, 410-O and 410P of Ar-
ticle 66C of the Annotated Code of Maryland (1970 Replacement
Volume), title "Natural Resources," subtitle "Forest and Parks, sub-
heading "Public Recreation on Private Lands," be and they are hereby
repealed and re-enacted, with amendments; and that new Sections
410Q and 410R be and they are hereby added to said Article of said
Code, title, subtitle and subheading, and all to read as follows:
410J.
The purpose of this subheading is to encourage owners of land to
make land and water areas available to the public for recreational
and educational purposes by limiting their liability toward persons
entering thereon for such purposes.
410K.
As used in this subheading:
(a) "Land" means land, roads, water, watercourses, private ways
and buildings, structures, and machinery or equipment when at-
tached to the realty.
(b) "Owner" means the possessor of a fee interest, a tenant, a
lessee, occupant or person in control of the premises.
(c) "Recreational purpose" includes any of the following, or any
combination thereof; hunting, fishing, swimming, boating, camping,
picnicking, hiking, pleasure driving, nature study, water skiing, win-
ter sports, horseback riding or HORSE driving, OPERATING
MOTORIZED RECREATIONAL VEHICLES, and viewing or en-
joying historical, archaeological, scenic or scientific sites.
(d) "Educational purpose" includes, but is not limited to any
of the following, or any combination thereof: nature study, farm
visitations for purposes of learning about the farming operation,
practice judging of livestock, dairy cattle, poultry, other animals,
agronomy crops, horticultural crops, or other farm products, or-
ganized visits to farms by school children, 4-H Clubs, FFA Clubs
and others as a part of their educational programs, and viewing
historical, archaeological or scientific sites.
[(d)] (e) "Charge" means the price or fee asked (1) for serv-
ices, entertainment, recreation or products performed or offered for
sale on the land or (2) in return for invitation or permission to enter
or go upon the land.
