Section 1. Be it enacted by the General Assembly of Maryland,
That Section 468(e) of Article 27 of the Annotated Code of Mary-
land (1971 Supplement), title "Crimes and Punishments," subtitle
"Crimes and Punishments," subheading "Litter Control Law," be
and it is hereby repealed and re-enacted, with amendments, and that
new Subsection 468(i) be and it is hereby added to said Article,
Code, title, subtitle and subheading, and to read as follows:

468.

(e) Any person violating the provisions of subsection (d) of this
section is guilty of a misdemeanor and upon conviction thereof shall
be punished by:

(1)    A fine of [not more than $250,003 $50.00, or by imprisonment
for not more than 30 days, or both such fine and imprisonment, or, in
lieu thereof,

(2)    In the sound discretion of any court in which conviction is
obtained, any such person may be directed by the judge of such
court to pick up and remove from any public street or highway or
public or private right-of-way, or public beach or public park, or,
with prior permission of the legal owner or tenant in lawful possession
of such property, any private property upon which it has been es-
tablished by competent evidence that he has deposited litter, any and
all litter deposited thereon by anyone prior to the date of execution
of sentence but if,

(3)    The violation of a provision of subsection (d) of this section
also constitutes a violation of another article of this Code which im-
poses a more severe punishment, then that punishment may also be
imposed.

(i) Fines collected for violations of this Act shall be disbursed
to the county or city where the violation occurred to be used to defray
the expense of establishment and maintenance of receptacles and
posting of signs as provided in subsection (h) of this section.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

(House Bill 855)

AN ACT to repeal and re-enact, with amendments, Section 40 (b) (3)
of Article 73B of the Annotated Code of Maryland (1970 Replace-
ment Volume), title "Pensions," subtitle "Social Security Benefits,"
authorizing the investment of Social Security contributions in
short-term securities of U.S. Government Agencies and short-term
notes of corporations by the board of trustees of the Employees'
Retirement System.

Section 1. Be it enacted by the General Assembly of Maryland,
