Sec. 2. And be it further enacted, That this Act shall take effect

AN ACT to add new Section 3(m) to Article 33B of the Annotated
Code of Maryland (1971 Replacement Volume and 1971 Supple-
ment), title "Environmental Service" to follow immediately after
Section 3(1) thereof; and to repeal and re-enact, with amend-
ments, Section 5(d) of Article 33B of the Annotated Code of
Maryland (1971 Replacement Volume) defining the term "Facility"
and providing that the Environmental Service consider the effects
of public versus private ownership of water and wastewater facil-
ities in formulating five-year plans.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 3(m) be and it is hereby added to Article 33B of
the Annotated Code of Maryland (1971 Replacement Volume and
1971 Supplement), title "Environmental Service" to follow immedi-
ately after Section 3(1) thereof and to read as follows:

(m) The term "facility" means a physical structure or appur-
tenance built, constructed, installed, or established to perform a
function or service in connection with a water supply, wastewater
purification or solid waste disposal project whether publicly or pri-
vately owned and whether existing or proposed.
Sec. 2. And be it further enacted, That Section 5(d) of Article
33B of the Annotated Code of Maryland (1971 Replacement Volume
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

(d). As soon as possible after the designation of a service region,
the Service shall cause surveys, plans, studies, and estimates to be
made and shall, after consultation with the municipalities located
within the service region, prepare a five-year plan for each service
region for the most effective and economical means of providing
waste water purification and solid waste disposal projects. In pre-
paring a five-year plan the Service shall consider the effects of public
versus private ownership of water and waste water facilities upon
the provision of dependable, effective and efficient water and waste
water services. The five-year plan shall give due consideration to the
