(e) (3) no known objection by the next of kin is foreseen by the
Chief Medical Examiner or his deputy THE ASSISTANT MEDICAL
EXAMINER; and
(d) (4) providing the organ for transplant will not interfere
with the subsequent course of an investigation or autopsy.
(B) THE CHIEF MEDICAL EXAMINER, THE DEPU-
TY CHIEF MEDICAL EXAMINER AND THE ASSISTANT
CHIEF MEDICAL EXAMINERS WILL NOT BE LIABLE FOR
CIVIL ACTION SHOULD THE NEXT OF KIN SUBSEQUENTLY
BE LOCATED AND CONTEND THAT HIS AUTHORIZATION
WAS REQUIRED, IF THE CHIEF MEDICAL EXAMINER HAS
OBTAINED A WRITTEN STATEMENT FROM THE TREATING
PHYSICIAN OR THE HOSPITAL WHERE THE PATIENT WAS
LOCATED THAT A REASONABLE UNSUCCESSFUL SEARCH
WAS CONDUCTED FOR THE NEXT OF KIN PRIOR TO THE
REMOVAL OF THE TISSUE FOR TRANSPLANTATION.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

AN ACT to repeal Sections 12 (a), (b), and (c) of Article 96A of
the Annotated Code of Maryland (1964 Replacement Volume, as
amended), title "Water Resource," subtitle "Appropriation of
Waters; Reservoirs and Dams," and to re-enact, with amendments,
Sections 12 (a) and (b) thereof, AND RE-ENACT, WITH
AMENDMENTS, SECTION 12(A) OF ARTICLE 96A OF THE
ANNOTATED CODE OF MARYLAND (1964 REPLACEMENT
VOLUME AND 1971 SUPPLEMENT), TITLE "WATER RE-
SOURCES," SUBTITLE "APPROPRIATION OF WATERS;
RESERVOIRS AND DAMS," AND TO REPEAL SECTIONS
12(B) AND 12(C) OF THE SAME ARTICLE, CODE, TITLE
AND SUBTITLE, AND TO ENACT NEW SECTIONS 12(B)
AND 12(C) IN LIEU THEREOF, TO STAND IN THE PLACE
OF THE SECTIONS REPEALED, AND TO ADD NEW SEC-
TION 12(D) TO THE SAME ARTICLE, CODE, TITLE AND
SUBTITLE, TO FOLLOW IMMEDIATELY AFTER SECTION
12(C) THEREOF, to remove the exclusions relating to certain
dams, obstructions, reservoirs, impoundments and drainage sys-
tems, and to change the exclusionary classification of "farm
ponds" to "small ponds," and to remove certain specifications for
the construction of farm ponds and embankments, AND RE-
LATING GENERALLY THERETO.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 12 (a), (b) and (c) of Article 96A of the Annotated
Code of Maryland (1964 Replacement Volume, as amended), title
"Water Resources," subtitle "Appropriation of Waters-; Reservoirs
