AND THE GENERAL ASSEMBLY REAFFIRMS ITS INTEN-
TION TO PREVENT SUCH COERCION BY CONTINUING
THE PROHIBITION AS APPLIED TO FRANCHISE RETAIL
MERCHANTS AS HEREINAFTER DEFINED.
(B) No retail establishment regulated or licensed pursuant to the
provisions contained in Article 56 of the Annotated Code of Maryland,
as amended, shall use any game, contests, lottery or other scheme or
device, whereby a person or persons may receive gifts, prizes or gratu-
ities as determined by chance for the purpose of promoting, further-
ing or advertising the sale of any product or service of whatsoever
nature or kind, and the fact that no purchase is required in order to
participate in the game, contest, lottery or scheme shall not exclude
such game, contest, lottery or scheme from the provisions of this
section. Nothing in this section shall be construed as preventing any
retail merchant NON-FRANCHISE RETAIL MERCHANT IN
FREDERICK AND CARROLL COUNTIES from giving away any
prize or prizes by the act of drawing of a name or names if no pur-
chase or contest is required to qualify for the prize or prizes.
(C) FOR THE PURPOSE OF THIS SECTION "FRAN-
CHISE" MEANS AN AGREEMENT BETWEEN A DISTRIB-
UTOR AND A DEALER UNDER WHICH THE DEALER IS
GRANTED THE RIGHT TO OCCUPY PREMISES OWNED,
LEASED OR CONTROLLED BY THE DISTRIBUTOR, FOR
THE PURPOSE OF ENGAGING IN THE RETAIL SALE OF
PRODUCTS OF THE DISTRIBUTOR.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

AN ACT to repeal and re-enact, with amendments, Section 195(11)
of Article 77 of the Annotated Code of Maryland (1969 Replace-
ment Volume) title "Public Education," subtitle "Chapter 17.
Teachers' Retirement System," to permit CERTAIN persons re-
ceiving their retirement annuity through the State Teachers' Re-
tirement System to elect to have the premiums for medical
insurance paid DEDUCTED out of annuities from that Retirement
System TO MAKE THIS ACT APPLICABLE TO BALTIMORE
CITY OR ANY OF THE COUNTIES, and generally relating
thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 195(11) of Article 77 of the Annotated Code of Mary-
land (1969 Replacement Volume), title "Public Education," subtitle
"Chapter 17. Teachers' Retirement System," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:
