For purposes of county taxation in Prince George's County only,
and in the discretion of the County Executive and County Council,
so directing, THE COUNTY COUNCIL MAY, BY RESOLUTION
OR ORDINANCE, PROVIDE FOR THE EXEMPTION OF real
property, title to which is held by nonprofit community civic
associations or corporations, which property is dedicated by
appropriate plat or deed restrictions to the use of the lot
owners within the community, and which use is not contingent upon
the payment of dues to the association or corporation or upon the
payment of fees or other compensation in return for admission to or
use of the property. As used in this paragraph, "dues" and "fees or
other compensation" do not include assessments exacted and employed
by the association solely for the improvement or maintenance of the
roads, property, or other facilities of the community.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

AN ACT to repeal and re-enact, with amendments, Section 369A of
Article 27 of the Annotated Code of Maryland (1971 Replacement
Volume), title "Crimes and Punishments," subtitle "Crimes and
Punishments," subheading "Lotteries" to exempt NON-FRAN-
CHISE retail merchants IN FREDERICK AND CARROLL
COUNTIES from the provisions of this Section under certain
circumstances DEFINING A FRANCHISE FOR THE PUR-
POSE OF THIS SECTION, AND PROVIDING FOR A STATE-
MENT OF POLICY.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 369A of Article 27 of the Annotated Code of Maryland
(1971 Replacement Volume), title "Crimes and Punishments," sub-
title "Crimes and Punishments," subheading "Lotteries," be and it
is hereby repealed and re-enacted with amendments, to read as
follows:

(A) THE GENERAL ASSEMBLY OF MARYLAND WHILE
PROVIDING FOR AN EXCEPTION IN CERTAIN COUNTIES
UNDER CERTAIN CIRCUMSTANCES TO THE PROHIBI-
TIONS OF THIS SECTION, FINDS THAT FRANCHISE RE-
TAIL MERCHANTS AS CONTRASTED WITH NON-FRAN-
CHISE RETAIL MERCHANTS HAVE OFTEN IN THE PAST
BEEN COERCED BY THEIR FRANCHISING SUPPLIERS
INTO THE UTILIZATION OF THE GAMES, CONTESTS, LOT-
TERY OR OTHER SCHEMES OR DEVICES SUBSEQUENTLY
PROHIBITED BY THE ENACTMENT OF THIS SECTION,
