be entitled to receive said sum without prejudice to any of its


rights if it agrees to pay back to the Authority the difference be-

tween said sum and the final award, if such final award be less

than the sum paid into court; such payment, however, shall in

nowise limit the amount to be allowed under subsequent condemna-

tion proceedings, and the Authority shall pay to the Mayor and

City Council of Baltimore from any funds in its possession or under
its control, any further sum that may subsequently be finally

awarded in subsequent condemnation proceedings. Within ninety

(90) days after possession of the tract of land is taken by the Au-

thority, if the Authority and the Mayor and City Council of Balti-
more are unable to agree as to proper and adequate compensation,

then the Authority shall institute condemnation proceedings in the

manner prescribed by the provisions of Article 33A of the Anno-
tated Code; provided further, however, that the Mayor and City

Council of Baltimore, at any time subsequent to the payment of

such sum into court, may request in writing to the Authority that

such condemnation proceedings be instituted, and in such case it

shall be the duty of the Authority, within thirty (30) days after
receipt of such notice to institute such proceedings and the duty of

the court to hear and determine such proceedings as soon thereafter
as practicable. It is the intention of this section to
provide that such
tract of land shall be imme
diately condemned upon its reversion to

the Mayor and City Council of Baltimore, it being the primary pur-
pose of this subtitle to consolidate wholesale food market places in

a single market within the Greater Baltimore Region.

(C) UPON THE CLOSING OF THE NEW MARSH WHOLE-
SALE PRODUCE MARKET, THE TITLE TO ALL OF THE
PROPERTY OF THE NEW MARSH WHOLESALE PRODUCE
MARKET AUTHORITY, AS CONVEYED BY THE MAYOR AND
CITY COUNCIL OF BALTIMORE TO THE NEW MARSH
WHOLESALE PRODUCE MARKET AUTHORITY PURSUANT
TO ORDINANCE NO. 1019, APPROVED JULY 11, 1957, SHALL
REVERT TO THE MAYOR AND CITY COUNCIL OF BALTI-
MORE. IN THE EVENT THAT THE TITLE TO THE PROPERTY
OF THE NEW MARSH WHOLESALE PRODUCE MARKET
AUTHORITY REVERTS TO THE MAYOR AND CITY COUN-
CIL OF BALTIMORE AS PROVIDED IN THIS SECTION, THE
MAYOR AND CITY COUNCIL SHALL PAY TO THE STATE
OF MARYLAND THE FAIR MARKET VALUE FOR PURPOSES
OTHER THAN AS A WHOLESALE FRESH FRUIT AND VEG-
ETABLE MARKET OR FOR WHOLESALE DISTRIBUTION OF
FOOD PRODUCTS OF ANY NEW CONSTRUCTION OR IM-
PROVEMENTS MADE TO THE PROPERTY OF THE AUTHOR-
ITY AFTER JULY 1, 1972.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
