money which has been provided to the Authority under the provi-
sions of this article SUBTITLE or any other law and money which
the Authority is legally entitled to receive under any legal instru-
ment or from any other source.
(e) The County, City and all public agencies and commissions of
the State, may sell, lease, rent, lend, grant, or convey to the Authority
at its request, upon such terms and conditions as the proper authori-
ties of the County, City, agencies, or commissions of the State may
deem reasonable and fair, any real or personal property which may
be necessary or convenient to the effectuation of the authorized pur-
poses of the Authority, including property already devoted to public
use.
47A-I.
(a) There is hereby imposed upon every local public bus trans-
portation system operating in the county a surcharge in the amount
of 2¢ per gallon of gasoline or other fuel used by that system and in
addition an annual rental fee in the amount of $300 per motor coach
owned by the Authority and leased to a private operator. The sur-
charge shall be payable monthly on or before the last day of each
month and the annual rental fee shall be payable on or before
December 1 of each year. The amount of the surcharge and rental
fee may be changed by the Authority from time to time.
(b) The Authority may borrow from the State, the City or the
County, jointly or severally, or from any other source; and the
State and any of the aforementioned political subdivisions thereof
THE COUNTY, jointly or severally, or any other legal entity, may
lend to the Authority out of or from funds which they or any of them
may have available for such purpose, a sum of money not exceeding
fifty thousand dollars, upon such terms and conditions and upon the
execution of such legal instruments as may be mutually agreed upon
by the parties to any such transaction. The Authority shall repay the
principal amount of any such loan and all interest due in connection
therewith out of any funds which it may have available not later
than one year after the date of the said loan.
(a) The Authority has the power and authority to acquire, own
and operate any public bus transportation system now or hereafter
being operated or maintained within the County under the following
conditions and after the prescribed course of action has been first
carried out.
(b) The Authority shall use its powers to create the most favor-
able conditions for the continued operation of private mass trans-
portation companies within the County. The Authority, however,
shall consider the public requirements and convenience in all of its
decisions and directives.
(c) Upon the vote of a majority of the members of the Authority,
it shall be lawful for the Authority to acquire, own, and operate any
mass transportation bus company or companies now or hereafter
being operated within the County and over which the Authority has
jurisdiction. Said acquisition may be effected through purchase or
such other means, except condemnation, as the Authority may
determine.
