AN ACT to repeal and re-enact, with amendments, Section 76(d)
of Article 100 of the Annotated Code of Maryland (1964 Replace-
ment Volume and 1971 Supplement), title "Work, Labor and Em-
ployment," subtitle "State Employees," to provide that overtime
compensation shall not be paid to law-enforcement employees of
the State Police for hours worked as the result of loss of leave
attributed to disciplinary action by the Superintendent of the
Maryland State Police.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 76(d) of Article 100 of the Annotated Code of Mary-
land (1964 Replacement Volume and 1971 Supplement) title "Work,
Labor and Employment," subtitle "State Employees," be and it is
hereby repealed and re-enacted, with amendments, to read as
follows:
76.
(d) Law-enforcement employees of the Maryland State Police
and of the Department of Natural Resources who work in excess
of the normal one hundred (100) hour biweekly work period shall
receive overtime compensation which shall be computed by dividing
the biweekly compensation by the number of hours in the normal
biweekly work period and multiplying the resulting quotient by one
and one-half times the number of hours worked in excess of the
normal biweekly work period. The maximum yearly overtime to be
paid any one such employee is as follows:
Trooper, Trooper First Class and Natural
Resources Officers I and II.....„...............„.......................... $800 per annum
Corporal and Natural Resources Officer III____ 700 per annum
Sergeant and Natural Resources Officer IV____ 600 per annum
1st Sergeant and Natural Resources Officer V...... 500 per annum
2nd Lieutenant and Natural Resources Officer VI 400 per annum
1st Lieutenant and Natural Resources
Officer VII................................................................................ 300 per annum
Captain and Natural Resources Officer VIII...... 200 per annum
In the event an employee's rank is changed during the year, he
shall be entitled to the higher of the two applicable yearly overtime
maximums for the duration of the year. Overtime compensation
shall not be paid to law-enforcement employees taking basic train-
ing at the Police Academy, or to any law-enforcement employee
attending school or taking other training the length of which course
is more than thirty (30) days. Overtime payments shall not be
taken into consideration for retirement or pension purposes.
Overtime compensation shall not be paid to law-enforcement em-
ployees of the Maryland State Police for hours worked as a result
of loss of leave attributed to disciplinary action by the Superin-
tendent of the State Police. "Leave," as referred to in this paragraph,
means regular leave which is the two days of leave that normally
follows the five days of duty assigned said employees and not holi-
day, vacation or personal leave.
