(b)   Establish minimum requirements for financial responsibility
for all damages which may be incurred in the commercial applica-
tion of the pesticides.

(c)   Issue licenses to those meeting the requirements established
by the Board and reject any applications which do not meet those
requirements.

(d)  Establish the conditions under which licenses may be revoked.

(e)   Adopt rules and regulations governing the storage, sale, dis-
tribution, exchange,
use and disposal of pesticides and their con-
tainers.

(f)  Prescribe, when necessary, the time and conditions under
which certain pesticides may be sold, distributed, exchanged, or used
in different areas of the State, and provide, if necessary, that ex-
tremely hazardous materials shall be sold, distributed, exchanged, or
applied only under special permission from the Board.

(g)  Define the formulations and establish the conditions and
appropriate areas for aircraft application of any pesticides.

(h) Create guidelines and requirements for the application of
pesticides by public agencies and bodies politic. These shall in-
clude the qualifications of the responsible employees and provision
of records to the Board.

(i) Design and conduct an appropriate educational program on
the values of pesticides and the necessity for care in their applica-
tion.

(j) Encourage research which will contribute to the optimal uses
of pesticides for maximum public benefit and minimum public dam-
age.

(k) Establish such record systems for pesticide use as may be
essential for the public welfare.

(1) Employ such inspectors and other employees as may be neces-
sary for the proper enforcement of the provisions of this subtitle
and the rules and regulations promulgated hereunder.

110A-4.

The fee for a custom applicator license, [or] a pest control con-
sultant license or a pest control operator license is $100.00 $30.00.

110A-5.

All applications of pesticides shall be by licensed persons with the
following exemptions:

(a)  The application by aircraft of any substance with the inten-
tion of changing, or tending to change, atmospheric conditions.

(b)  The application of fertilizer, seeds, or any other similar sub-
stances so specified by the Board, when applied by some medium
other than aircraft, unless they contain pesticides.

(c)  Application of pesticides under permit for research or other
purposes from the Board to recognized colleges and universities,
