(g) "Custom applicator" means any person who, for hire, in this
State, by contract or otherwise, applies by aerial, ground, or any
hand or mechanical equipment, pesticides, to any waters, land, plants,
farm structures or animals.

(h) "Pest control consultant" means any person who, for a fee,
offers or supplies technical advice or supervision, or recommends the
use of specific pesticides, for the purpose of controlling pests in any
waters, lands, plants, farm structures or animals.

(i) "Pest control operator" means a person engaged, for hire,
in the business of structural pest control, commercial extermination
or fumigation, or in any other service involving the use of pesti-
cides or devices in this State for the control, eradication, mitigation,
or prevention of pests in or around houses or buildings.

110A-2.

(a)  Each custom applicator, [or] pest control consultant, and
pest control operator
is required to obtain an annual license from
the Board, subject to the exemptions of Section 110A-5.

(b)   Each application must be accompanied by a license fee and
evidence of such financial responsibility as shall be required by the
Board.

(c)  All fees collected under the provisions of this subtitle shall be
placed in a special fund known as the "Pesticide Fund" which fund
is hereby appropriated to the Board and shall be used for the
administration of the provisions of this subtitle.

110A-3.

The Board, by suitable administrative procedures, including public
hearings when appropriate, shall:

(a) Establish qualifications for licensing in each category to assure
competence and responsibility in the application of pesticides. IN
ESTABLISHING QUALIFICATIONS, FORMAL EDUCATION IN
ENTOMOLOGY, PEST CONTROL AND PRACTICAL EXPE-
RIENCE WILL BE CONSIDERED. EACH APPLICANT FOR A
LICENSE SHALL DEMONSTRATE HIS COMPETENCE TO
SAFELY USE AND APPLY PESTICIDES IN MARYLAND BY
SATISFACTORILY PASSING A WRITTEN AND/OR ORAL
EXAMINATION PREPARED AND ADMINISTERED BY THE
BOARD. SUCH LICENSE, ONCE GRANTED, SHALL THERE-
AFTER BE RENEWABLE ANNUALLY BY PAYMENT OF THE
REQUIRED LICENSE FEE, DEMONSTRATION OF THE RE-
QUIRED EVIDENCE OF FINANCIAL RESPONSIBILITY, AND
SATISFACTORY KNOWLEDGE OF THE USE OF PESTICIDES.
ANY APPLICANT FOR A PEST CONTROL OPERATOR'S LI-
CENSE WHO MAKES APPLICATION PRIOR TO JANUARY 1,
1973 AND WHO HAS BEEN ACTIVELY ENGAGED AS A PEST
CONTROL OPERATOR FOR THREE YEARS IMMEDIATELY
PRECEDING THE DATE OF HIS APPLICATION SHALL MAY
BE ISSUED A LICENSE UPON PAYMENT OF THE REQUIRED
FEE WITHOUT EXAMINATION. , AND UPON DEMONSTRA-
TION OF THE REQUIRED ESTIMATES OF FINANCIAL RE-
SPONSIBILITY AND SATISFACTORY KNOWLEDGE OF THE
USE OF PESTICIDES.
