vide for the release of investigatory information by the Commis-
sion to certain government officials; to authorize the Commission
to make rules and regulations; to provide for judicial review of a
final decision or order of the Commission; to provide for the en-
forcement of the Commission's decision and order; to provide
criminal penalties for complaints maliciously made; and relating
generally to the laws of this State concerning the Human Relations
Commission.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 2, 14 (a) and 16 (a) of Article 49B of the Annotated
Code of Maryland (1968 Replacement Volume and 1971 Supplement) ,
(1972 REPLACEMENT VOLUME), title "Human Relations Com-
mission," subtitles "Commission on Human Relations," and "Enforce-
ment Powers of Commission," be and they are hereby repealed and
re-enacted, with amendments; that new Section 4 be and it is hereby
added to the said Code, article, title, subtitle "Commission on Human
Relations," to follow immediately after Section 3 thereof; that new
Section 14 (g) be and it is hereby added to the said Code, article, title,
subtitle "Enforcement Powers of Commission," to follow immediately
after Section 14 (f) thereof; and that Section 15 of said Code, article,
title and subtitle, be and it is hereby repealed and that new Sections
15, 15A and 15B be and they are hereby enacted in lieu thereof, to
stand in the place of the section so repealed; and all to read as follows:
[The members of said Commission except the chairman shall not
receive any compensation for their services but shall be paid their
reasonably necessary expenses while engaged in the discharge of their
official duties.] The chairman of the Commission shall be paid such
compensation as shall be provided in the budget. The other members
of the Commission shall receive per diem compensation as shall be
provided in the budget for each day actually engaged in the discharge
of their official duties. All members of the Commission shall receive
reimbursement for all necessary and proper expenses while engaged
in the discharge of their official duties,
The Governor shall appoint an executive director and a deputy
director, each of whom shall be paid such compensation as shall be
provided in the budget, and who shall perform such duties as may
be prescribed by said Commission. In addition, in the absence of the
executive director, the deputy director shall perform all functions
and exercise all authority of the executive director. [The chairman
of the Commission shall be paid such compensation as shall be pro-
vided in the budget.] A Hearing Master appointed pursuant to
Section 14 of this article shall receive per diem compensation as shall
be provided in the budget for each day actually engaged in the dis-
charge of his official duties as well as reimbursement for all necessary
and proper expenses.
The Commission is authorized to employ its own attorney, who
shall be appointed by the Governor, and who shall be paid such com-
pensation as shall be provided by law, and who shall act as general
counsel and legal advisor to the Commission and shall represent the
Commission at all hearings and judicial proceedings in which the
Commission is a party.
