1278                             Laws of Maryland                      [Ch. 400

NUMBER OF MEMBERS ELECTED TO THE HOUSE OR
SENATE AND APPLYING THE SAME RATIO TO THE MEM-
BERSHIP OF THE COMMITTEE, RESOLVING ANY FRAC-
TION TO THE NEAREST WHOLE NUMBER. IN NO CASE
SHALL THE MINORITY PARTY REPRESENTATION BE LESS
THAN ONE. IN ALTERNATE YEARS THE PRESIDENT AND
THE SPEAKER SHALL NAME THE CHAIRMAN OF THE COM-
MITTEE, ALTERNATING BETWEEN MEMBERS FROM THE
TWO HOUSES.

(C)  THE COMMITTEE MAY INQUIRE INTO ANY FAILURE,
ACTUAL OR ALLEGED, OF AN OFFICER OR EMPLOYEE OF
EITHER THE LEGISLATIVE, EXECUTIVE, OR JUDICIAL
BRANCHES OF THE STATE GOVERNMENT TO COMPLY
WITH THE STATUTORY OR CONSTITUTIONAL LAW OF
THE STATE. IT MAY REVIEW THE RULES AND REGULA-
TIONS WHICH ARE ADOPTED AND PROMULGATED BY ANY
OF THE SEVERAL DEPARTMENTS, BOARDS, COMMISSIONS,
OR OTHER AGENCIES OF THE EXECUTIVE BRANCH [, IN
ORDER TO STUDY THE LEGALITY OF THEIR ADOPTION
AND CONTENT;] . [AND IT] IT MAY REVIEW THE OPERA-
TIONS AND CONTROLS OF ANY SUCH DEPARTMENT,
BOARD, COMMISSION, OR OTHER AGENCY, MAKING REC-
OMMENDATIONS IN THE DISCRETION OF THE COMMITTEE
FOR IMPROVEMENTS IN THESE OPERATIONS AND CON-
TROLS.

(D)  THE COMMITTEE IS AN ADJUNCT OF THE LEGIS-
LATIVE COUNCIL, BY WHICH IT SHALL BE SUPPLIED
WITH FUNDS, STAFF ASSISTANCE, AND PROCEDURAL AID;
AND THE COMMITTEE HAS ALSO THE SAME POWERS AS
ARE GIVEN THE LEGISLATIVE COUNCIL IN SECTION 30
OF THIS ARTICLE.

(E)  AT LEAST ONCE EACH YEAR THE COMMITTEE
SHALL REPORT TO THE MEMBERS OF THE LEGISLATIVE
COUNCIL AND OF THE GENERAL ASSEMBLY OF ITS WORK
AND STUDIES OF THE YEAR, TOGETHER WITH ANY REC-
OMMENDATIONS IT MAY HAVE FOR THE MORE EFFEC-
TIVE OPERATIONS OF THE THREE BRANCHES OF GOV-
ERNMENT WITHIN THE FRAMEWORK OF THE STATUTORY
AND CONSTITUTIONAL LAW OF MARYLAND. THE REPORT
SHALL ALSO INCLUDE ANY RECOMMENDATIONS FOR AP-
PROPRIATE LEGISLATIVE ACTION NECESSARY TO MOD-
IFY, CHANGE OR REVERSE ANY RULE, REGULATION OR
STANDARD WHICH THE COMMITTEE HAS CONSIDERED.

(F)  AT LEAST THIRTY (30) DAYS PRIOR TO THE ADOP-
TION OF ANY RULE, REGULATION, OR STANDARD BY ANY
OF THE SEVERAL DEPARTMENTS, BOARDS, COMMISSIONS,
OR OTHER AGENCIES OF THE EXECUTIVE BRANCH, THE
RULE, REGULATION OR STANDARD SHALL BE SUBMITTED
TO THE COMMITTEE. HOWEVER, THE SUBMISSION OF THE
PROPOSED RULE, REGULATION OR STANDARD TO THE
COMMITTEE SHALL NOT PREVENT THE ADOPTION AND
PROMULGATION OF SUCH RULE, REGULATION OR STAND-
ARD BY THE DEPARTMENT, BOARD, COMMISSION OR
OTHER AGENCY.
