recreation, or in both forestry and parks and recreation. In filling
the position of Director, the Governor shall receive and consider
all applications from any persons including present employees of
the Department who are able to meet the requirements set out
herein for the position of Director.
(c) Before assuming the duties of his office, the Director is re-
quired to take the constitutional oath of office.
(d) The Director is in sole and active charge of the Department,
subject only to his responsibility to the Secretary of Natural Re-
sources. From and after July 1, 1969, all powers, functions, duties
and responsibilities of the Commission of Forests and Parks under
Sections 390, 391, 392, 393, 394, 396, 397, 399, 401, 402, 403, 404,
405, 406, and 408 of this article shall be transferred to and exercised
by the Director and whenever the word "Commission" appears in
those sections it shall be deemed to mean "Director." However
all licenses issued by the Commission pursuant to any of the afore-
going sections shall continue in effect unless and until they are
revoked or suspended or they expire as provided by law. All rules,
regulations, directives, forms, orders and determinations of the Com-
mission pursuant to such aforegoing sections of this article shall
remain in effect until changed by the Director in the manner pro-
vided by law, and violations of the Commission's rules or regulations
remaining in effect shall continue to be subject to the penalties
provided by law.]

The [Director of the Department in accordance with the provisions
of the State merit system in Article 64A of this Code] Secretary
shall appoint ;[, subject to the approval of the Secretary of Nat-
ural Resources,] the State Forester and the Superintendent of
State Parks. [The State Forester shall have special training and
experience in forestry and shall be a graduate of an accredited
school of forestry. He shall have charge of all forests in the State
subject to the direction of the Director of the Department. The
Superintendent of State Parks shall have special training and ex-
perience in parks and recreation. He shall have charge of all park,
recreational and natural areas in the State subject to the direction of
the Director of the Department. The State Forester and the Super-
intendent of State Parks shall receive such salaries as shall be pro-
vided in the annual State budget.]

[(b) The provisions herein contained do not confer upon the
Department of Forests and Parks authority of any kind or degree
as respects the administration of lands under the jurisdiction of the
Department of Game and Inland Fish or lands that may be acquired
in the future by the said Department.]
Sec. 4. And be it further enacted, That Sections 4 and 5 of
Article 96A of the Annotated Code of Maryland (1971 Supplement),
title "Water Resources," subtitle "General Provisions," be and are
hereby repealed, and that Section 3 of the same Article 96A, title
"Water Resources," subtitle "General Provisions," be and is hereby
repealed and re-enacted, with amendments, and that Section 1 (b)
