Board of Public Works to be issued, and the governing bodies of each
of the counties and of Baltimore City shall forthwith levy and collect
such tax at such rate.
All matters committed by this Act to the discretion of the Board
of Public Works shall be determined by a majority of said Board.
Sec. 44 12. And be it further enacted, That, except as otherwise
indicated herein, moneys derived from the sale of bonds authorized
by this Act shall be used only for capital improvements and for no
other purpose. In determining whether an expenditure represents a
capital improvement, the Board of Public Works shall be guided by
the principle that a capital improvement is an improvement, the
useful life of which shall be at least equal to the life of the bonds
by which it is financed.
Sec. 42 13. And be it further enacted, That, if any portion (word,
sentence, paragraph, proviso or section) of this Act shall be held
invalid for any reason, the remaining provisions shall remain in
full force and effect, and such invalid portion shall be considered
severed and deleted from this Act.
Sec. 13 14. And be it further enacted, That this Act shall take
effect June 1, 1971.

AN ACT to repeal subsection (b) and (c) of Section 49 of Article
26 of the Annotated Code of Maryland (1966 Replacement Vol-
ume and 1970 Supplement), title "Courts," subtitle "Pensions of
Judges and Their Widows"; to repeal and re-enact, with amend-
ments, Section 47(a), (47(b), 17(e), 49(a), 49(g) and 50 of said
Article, subtitles "Salaries of Judges," and "Pensions of Judges
and Their Widows"; and to add new subsection (j) to said
Section 49 of said Article, to follow immediately after sub-
section (i) thereof; AND 47(C) OF ARTICLE 26 OF THE
ANNOTATED CODE OF MARYLAND (1970 SUPPLE-
MENT), TITLE "COURTS," SUBTITLE "SALARIES OF
JUDGES," increasing the salaries of the several judges of
the Court of Appeals, the Court of Special Appeals, and the
eight Judicial Circuits; amending the laws of this State pro-
viding for pensions or salaries to be paid to these several judges
after termination of their active service; repealing certain laws of
this State relating to additional pension or salary to be received by
each of the judges of the Court of Appeals and Court of Special
Appeals; amending the laws of this State providing for benefits to
be received by these several judges who because of incapacitating
illness resign their positions before their sixtieth birthday;
providing for contributions by certain judges toward the
cost of their PENSIONS; ELIMINATING THE REQUIRE-
MENT THAT A JUDGE MUST BE ELECTED OR CON-
FIRMED PRIOR TO BECOMING ELIGIBLE FOR A PENSION
