Magistrates System," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

108.

(4)

(a) Calvert County.—There shall be one trial magistrate for
Calvert County who shall be either a graduate of a law school
within the State, or admitted to the practice of law in the State,
and who shall sit at Prince Frederick and at North Beach. The
magistrate shall receive an annual salary of eight thousand dollars
($8,000.00). The County Commissioners, shall provide and pay for
all necessary secretarial assistance, and the magistrate shall not
be eligible for the traveling expense allowance as provided in
Section 113 herein. The magistrate shall keep separate dockets
with respect to all cases and forfeitures relating to violations of the
ordinances of North Beach and Chesapeake Beach respectively and all
fines, penalties, forfeitures and costs collected by him IN CONNEC-
TION WITH SUCH MUNICIPAL VIOLATIONS, SHALL BE PAID
BY HIM to the treasurer of North Beach with respect to violations of
municipal ordinances of that municipality, and to the treasurer of
Chesapeake Beach with respect to violations of the municipal ordi-
nances of that municipality, such payments to be made not later than
the tenth day of each month with respect to collections received by
him during the month preceding. There shall be a substitute trial
magistrate who in the absence of the trial magistrate, may serve
as trial magistrate and he shall be compensated at the rate of
$50 per day while sitting in court as trial [magistarate] magistrate,
but his annual compensation shall not exceed five thousand dollars
($5,000).

(b) Every full-time trial magistrate for Calvert County holding
office prior to January 1, 1971, shall be paid after the termination
of his active service as such full-time trial magistrate, a pension
or salary to be calculated at the rate of five hundred dollars ($500)
per annum for each year, or part of a year thereof, of active service
as such full-time trial magistrate for Calvert County up to and
including twelve years of such service, including service after
January 1, 1971, so that the maximum pension or salary for such
service payable hereunder to any one person shall not exceed the
sum of six thousand dollars ($6,000) per annum. This subsection
shall not apply to substitute trial magistrates. A former trial magis-
trate who accepts a salaried public office or position, municipal,
county, State or federal, shall not be paid any pension or salary
so long as he remains in such office or position. In the event that
a retired TRIAL magistrate holding a salaried public office or position
should thereafter relinquish such office or position, and notify the
County Commissioners of Calvert County of such fact, then from
and after the date of such notification the trial magistrate shall be
entitled to all the benefits as provided by this subsection. The
County Commissioners of Calvert County are hereby expressly
authorized to levy for and pay pensions and salaries to such trial
magistrate as herein provided.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
