CHAPTER 369
(Senate Bill 225)

AN ACT to repeal and re-enact, with amendments, Sections 49 (a),
50, and 52 (a) and (b) of Article 73B of the Annotated Code of
Maryland (1970 Replacement Volume), title "Pensions," subtitle
"Baltimore City Police Department Death Relief Fund," and to
repeal Section 51 of said Article and subtitle, providing for an
increase in the number of elected members of the board of trustees;
providing that the Director of Fiscal Affairs shall be a member of
the board of trustees; changing the method and time of nomina-
tions and elections of members of the board of trustees and chang-
ing the term of service of the members; providing for the filling
of vacancies if an elected member dies, resigns, retires, or ceases
to be a member of the Department; relating generally to the board
of trustees; and eliminating the relief fund committee and eliminat-
ing references thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 49 (a), 50, and 52 (a) and (b) of Article 73B of the
Annotated Code of Maryland (1970 Replacement Volume), title
"Pensions," subtitle "Baltimore City Police Department Death Relief
Fund," be and they are hereby repealed and re-enacted, with amend-
ments; and that Section 51 of the same Article, title and subtitle, be
and it is hereby repealed.

49.

(a) The amount of benefit payable on account of the death of an
officer or a civilian employee whose death is proximately caused by
injuries sustained or by harm inflicted upon the body in the course
of the performance of their duty shall be $5,000.00 or such greater
amount as may be prospectively and uniformly established by reso-
lution adopted by the board [and approved by majority vote of the
relief fund committee]; and the amount of benefit payable on account
of the death of an officer or a civilian employee whose death is not
proximately caused by injuries sustained or by harm inflicted upon
the body in the course of the performance of their duty shall be
$500.00 or such greater amount as may be prospectively and uni-
formly established by resolution adopted by the board [and approved
by majority vote of the relief fund committee]. The benefits under
this subtitle shall be in addition to all other benefits provided by law
or by voluntary action of any person or persons.

50.

The fund established under this article shall be administered by a
board of trustees [with the advice of a relief fund committee].

[51.

(a) The relief fund committee shall consist of one (1) major,
elected by the majors and lieutenant colonels of the department; a
captain, lieutenant, sergeant and patrolman for each police district
of Baltimore City, who shall be elected by the officers assigned to
said district; a captain, lieutenant, sergeant and patrolman from
each of the following units, elected by the officers assigned to said
