CHAPTER 297
(House Bill 398)

AN ACT to repeal and re-enact, with amendments, Section 40(c)
of Article 10 of the Annotated Code of Maryland (1970 Supple-
ment), title "Attorneys at Law and Attorneys in Fact", subtitle
"State's Attorney", to provide for Anne Arundel County an
increase in the number of Assistant State's Attorneys and com-
pensation therefor and to provide for the appointment of tem-
porary Assistant State's Attorneys and compensation therefor.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 40(c) of Article 10 of the Annotated Code of Maryland
(1970 Cumulative Supplement), title "Attorneys at Law and
Attorneys in Fact", subtitle "State's Attorney" be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

40.

(c) In Anne Arundel County, (1) the State's Attorney's salary
is nineteen thousand dollars ($19,000.) annually,. (2) The State's
Attorney may appoint a deputy State's Attorney who shall serve
full time and whose salary shall be such compensation not exceeding
eighteen thousand five hundred dollars ($18,500.) annually as the
State's Attorney may deem proper. (3) The State's Attorney may
appoint [ten] twelve assistant State's Attorneys. The salary of two
assistant State's Attorneys shall be such compensation not exceeding
eighteen thousand five hundred dollars ($18,500.) ANNUALLY as
the State's Attorney may deem proper and they shall serve full time.
The full time assistant State's Attorneys during their term of office
shall not except in connection with and in performance of their duties
as assistant State's Attorneys, appear as counsel or represent any
party professionally before any court, magistrate, board, commission
or agency of this State or any county or political subdivision of this
State. It is intended by the provisions herein that the full time
assistant State's Attorneys shall not engage in the private practice
of law in any matter whatsoever. The salary of [four] six assistant
State's Attorneys, who shall serve full time or part-time as the State's
Attorney shall designate, shall be such compensation not exceeding
fourteen thousand dollars ($14,000.00) annually as the State's Attor-
ney may deem proper; the salary of four assistant State's Attorneys,
who shall serve full time or part-time as the State's Attorney shall
designate, shall be such compensation not exceeding twelve thousand
dollars ($12,000.00) annually as the State's Attorney may deem
proper. (4) The State's Attorney may appoint one administrative
assistant whose salary shall be as set by the County Council of Anne
Arundel County but not less than five thousand dollars ($5,000.00)
annually. (5) The State's Attorney may from time to time, if deemed
wise or necessary, with the approval of the senior judge of the
Circuit Court for Anne Arundel County, appoint a temporary assist-
ant State's Attorney for a particular case or series of cases and may
fix the compensation therefor.

Sec. 2. And be it further enacted, That all laws or parts of laws,
public general or public local inconsistent with the provisions of
this Act, are hereby repealed to the extent of any such inconsistency.
