Code of Maryland (1965 Replacement Volume and 1970 Cumulative
Supplement), title "Comprehensive Drug Abuse Control and Rehabil-
itation Act," and that Sections 2, 3, 4 and 5 of the same Article be
and they are hereby repealed and re-enacted with amendments, all
to read as follows:
1A.
(a) The Drug Abuse Administration is hereby established as a
part of the Department of Health and Mental Hygiene. The head
and chief executive officer of the Drug Abuse Administration shall
be the Director of the Drug Abuse Administration. There shall also
be a Deputy Director of the Drug Abuse Administration who shall
assist the Director in the performance of the Director's duties. The
Director and Deputy Director shall be appointed by the Governor
with the advice of the Secretary of Health and Mental Hygiene, and
shall serve at the pleasure of the Secretary. However, the Secretary
may not remove the Director or Deputy Director without obtaining
the prior approval of the Governor. The Director and Deputy
Director shall receive such salaries as are provided in the State
budget. The Director shall report directly to the Secretary of Health
and Mental Hygiene and shall, subject to the authority of the Secre-
tary, be responsible for carrying out the powers, duties, responsibili-
ties and functions vested in the Drug Abuse Administration.
(b) The Drug Abuse Authority, and the office of Director of the
Drug Abuse Authority, are hereby abolished. From and after May
1, 1971, all rights, powers, duties, obligations and functions hereto-
fore conferred upon or exercised by the Drug Abuse Authority and
the office of Director of the Drug Abuse Authority, shall be trans-
ferred to and shall, subject to the authority of the Secretary of Health
and Mental Hygiene, be exercised by the Drug Abuse Adminis-
tration.
(c) All rules, regulations, forms, orders and directives promul-
gated by or in effect for the Drug Abuse Authority as of April 30,
1971, shall continue in force unless and until changed by the Director
of the Drug Abuse Administration or the Secretary of Health and
Mental Hygiene.
(d) All references in this Code, other laws, ordinances, reso-
lutions, rules, regulations, directives, appropriations, legal actions,
contracts or other documents to the Drug Abuse Authority shall be
deemed to mean the Drug Abuse Administration.
(e) All persons who are as of April 30, 1971, officers and em-
ployees of the Drug Abuse Authority, but not including the members
of the Drug Abuse Authority or the Director of the Drug Abuse
Authority, are hereby confirmed in the office, position and classifica-
tion which they hold as of April 30, 1971, as officers and employees
of the Drug Abuse Administration, until they retire, resign, or are
removed as provided by law.
2. Definitions.
As used in this article—
(a) "The Authority" or "the Administration" means the Drug
Abuse [Authority] Administration established by Section 1A of
this Article.
