CHAPTER 89
(Senate Bill 455)

AN ACT to repeal and re-enact, with amendments, Section 90A
of the Code of Public Local Laws of Harford County (1965 Edition,
being Article 13 of the Code of Public Local Laws of Maryland),
title "Harford County," subtitle "Auctioneers," as added by Chap-
ter 315 of the Acts of 1970; to alter the percentage allowed for mini-
mum auctioneer fees in the absence of an auctioneer fee schedule
in Harford County, and to clarify the language therein.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 90A of the Code of Public Local Laws of Harford
County (1965 Edition, being Article 13 of the Code of Public Local
Laws of Maryland), title "Harford County," subtitle "Auctioneers,"
as added by Chapter 315 of the Acts of 1970, be and the same are
hereby repealed and re-enacted, with amendments, to read as follows:

90A.

(a)  Notwithstanding Rule B.R. 1 entitled "Auctioneers Commis-
sion" of the Rules of the Third Judicial Circuit of Maryland, the
judge or judges of the Circuit Court for the Third Judicial Circuit
who reside in Harford County may establish a schedule of auctioneer
fees to be a part of expenses incurred at a sale under decree of an
order of court or other judicial sale of real, leasehold, or personal
property. If the aforesaid schedule is not adopted by the judge or
judges of the Circuit Court of Harford County, then the (said]
judges shall establish for Harford County the schedule of auctioneer
fees in subsection (b):

(b)   On sales of real or leasehold estate under a decree or an order
of court minimum fees shall be allowed an auctioneer for his services
as follows: For the sale of real or leasehold estate [¼] ½ of 1%
provided that the minimum fee shall not be less than $50 nor the
maximum more than $200.

(c)  The Court may, for good cause shown, increase the allowance
for fees to an auctioneer.

(d)  In event of the withdrawal of a sale of real or leasehold
property after the sale has actually begun the auctioneer shall receive
the minimum commissions and fees set forth in subsection (b) of this
rule.

(e)  An auctioneer shall not be required to perform any service
prior to the actual sale, to attract bidders. His duties shall consist
solely of conducting the bidding at the sale and announcing the
purchasers.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
