by the Department of Permits and Licenses, together with any supporting
data as may be required for the proper review of the plans.
3.3 The pool and/or beach facilities shall be built in accordance with
the plans as approved unless changes have been submitted in writing and
approved. The pool and/or beach shall not be placed in operation until
compliance with the requirements of these regulations.
3.4 The criteria followed by the Department of Health in the review
and approval of plans shall be in accordance with the standards set
forth in "Design, Regulations, and Criteria for Public Swimming Pools
and Bathing Beaches in Baltimore County" as approved by the Board
on April 22, 1969, and accompanying this ACT. Said regulations are
hereby adopted and incorporated by reference in this subsection as if
fully set forth herein.
(d) PERMITS TO OPERATE
4.1 No person shall operate or maintain a public swimming pool
or bathing beach unless he has obtained a permit to operate such pool
or beach from the Department of Permits and Licenses. Such permits
shall be obtained by May 1, and shall be valid for one year unless other-
wise revoked. Only persons who comply with these regulations shall be
entitled to receive and retain such a permit. Such permits are not trans-
ferrable. The Department of Health may recommend suspension of any
permit for failure to comply with proper operational procedures as set
forth in "Design, Regulations, and Criteria for Public Swimming Pools
and Bathing Beaches in Baltimore County" referred to in this Act.
The Department of Permits and Licenses may revoke the permit upon
recommendation of the Approving Authority.
(e) HEALTH AND SAFETY.
5.1 No person having a communicable disease shall be employed at
a public swimming pool or bathing beach, and all patrons or swimmers
suspected of having such a disease shall be excluded.
5.2 Appropriate facilities shall be provided for the safety of bathers
as may be required by the Approving Authority. Competent lifeguard
service shall be provided during all swimming periods. A competent life-
guard shall be one who holds a current American Red Cross Senior
Lifesaving Certificate or its equivalent. There shall be a minimum of one
lifeguard and an adequate number of additional lifeguards as required by
the Approving Authority.
5.3 Every swimming pool or beach shall be under the supervision
of a capable individual who shall assume the responsibility for compliance
with all parts of this Act relating to pool operation and maintenance,
and safety of bathers. A capable individual is one who has successfully
completed a course for pool operators as recognized by the Approving
Authority. OR WITH FIVE CONSECUTIVE YEARS OF POOL MAN-
AGEMENT TO THIS DATE. This operators course shall be mandatory
by May 1, 1971.
(f) INSPECTION.
6.1 The Department of Health is authorized to conduct such inspec-
tion as it deems necessary to insure compliance with all provisions of this
Act, and shall have right of entry at any time the pool is open and
operational.
