prisoners in the Anne Arundel County Detention Center, and provid-
ing for the administration thereof, payment for work and time off
for good behavior; creating a misdemeanor and providing penalties
for enabling a prisoner to escape, and matters generally related
thereto.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Section 16-22 of the
Anne Arundel County Code (1957 Edition), Chapter 16, "Police," be and
it is hereby repealed, and that new Sections 14-200 through 14-204, in-
clusive, be and they are hereby added to said Code (1967 Edition and
Supplements), Title 14, "Police," to be under the new Subtitle 10, "Pris-
oners—County Detention Center," to follow immediately after Section
14-101 thereof, and to read as follows:
Subtitle 10. Prisoners—County Detention Center
Section 14-200
(a) Any male prisoner over eighteen (18) years of age confined in
the Anne Arundel County Detention Center by the Circuit Court or the
People's Court having criminal jurisdiction, may perform work, not to
exceed ten (10) hours in any one day, during the period of his imprison-
ment (1) in the Detention Center; (2) on the public roads or other public
property of the County; (3) on the public roads or other public property
of the State of Maryland within the County; (4) in the event of community
disasters or emergencies on public or private property; or (5) in any
special taxing area in the County; provided, that for such work on the
public streets or other public property of the State of Maryland or of a
special taxing area, the authorities of the special taxing area or the State
of Maryland shall, by agreement with Anne Arundel County, be charged
with the expense which may attend such employment.
(b) Any prisoner working outside of the confines of the Anne
Arundel County Detention Center shall receive compensation at the rate
of Three Dollars ($3.00) per day.
(b) The assignment of any prisoner to such a work detail shall be
subject to the approval of the Chief of Police of Anne Arundel County, or
his designee.
Section 14-201
Any prisoner assigned to a work detail, whether inside or outside
of said Detention Center, whose performance and conduct is evaulated as
satisfactory by the Chief of Police or his designee shall be entitled to have
one (1) day of his sentence deducted for each five (5) days during which
his work performance has been so evaluated.
Section 2. AND BE IT FURTHER ENACTED, That if any provision
of this Ordinance or the application thereof to any person or circumstance
is held invalid for any reason, such invalidity shall not affect the other
provisions or any other application of this Ordinance which can be given
effect without the invalid provisions or application, and to this end, all
provisions of this Ordinance are hereby declared to be severable.
Section 3. AND BE IT FURTHER ENACTED, That all laws or parts
of laws, inconsistent with the provisions of this Ordinance are hereby
repealed to the extent of any such inconsistency.
