Bill No. 21-70

An Ordinance to repeal and re-enact, with amendments, Section
17-400 of the Anne Arundel County Code (1967 Edition and Supple-
ments), Title 17, "Taxation," Subtitle 4, "Erosion District Taxes," to
correct a reference in the law.

Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Section 17-400 of the
Anne Arundel County Code (1967 Edition and Supplements), Title 17,
"Taxation," Subtitle 4, "Erosion District Taxes," be, and it is hereby
repealed, and new Section 17-400 is enacted in lieu thereof, to stand in
the place and stead of the section so repealed, and to read as follows:

Section 17-400

The council is authorized and empowered when acting as a district
council under the powers bestowed by Chapter 645 of the 1955 Laws of
Maryland
[article 25 of the Annotated Code of Maryland, 1957, sections
161 to 167, inclusive], to advance from county general surplus funds, such
funds as may become necessary to repair or replace existing erosion pre-
vention facilities; such advances not to exceed in total five per cent of the
total assessable basis of the taxing and assessment district involved, to be
repaid over a period of not in excess of ten years, and at a rate of interest
equal to the then existing return on investments of other county funds;
further, to authorize a special levy annually in such district in an amount
sufficient to repay such advances over the period of years as provided,
plus the amounts required for regular maintenance and repair, plus such
administrative cost as may be anticipated; such administrative cost not
however to exceed, in any one year, five per cent of the annual special
levy or one hundred dollars, whichever is greater; provided, that the sum
total of outstanding advances under this section may not at the time they
are authorized, exceed ten per cent of the total general county surplus
available at the end of the preceding fiscal year; and provided further, that
before any advance shall be made by the council acting as a district council
to a particular taxing and assessment district, the district council shall
require that fifty per cent or more of the property owners in the particular
taxing and assessment district sign a petition expressing their favorable
consent for such advance, loan and special tax.

Section 2. AND BE IT FURTHER ENACTED, That this Ordinance
shall take effect forty-five (45) days from the date it becomes law.

Bill No. 22-70

An Ordinance to add new Section 17-703 (k) to the Anne Arundel
County Code (1967 Edition and Supplements), Title 17, "Taxation,"
Subtitle 7, "Miscellaneous Taxes" to follow immediately, after Section
17-703 (j) thereof creating the Venice Beach Community District
defining the limits of said area and the purposes thereof; and matters
generally related thereto.

Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That new Section 17-703 (k)
