by the court. If the court orders the abandonment, the Clerk of the
court is directed to furnish copies of the court order to the Supervisor
of Assessments of Montgomery County and to the governmental agencies
specified herein, whenever the area abandoned is within their respective
jurisdiction, and the Clerk of the court shall endorse, on the original record
plat affected thereby, the dates and place of record of such court order;
provided, however, that this section shall not apply to the abandonment
of drainage ways, streets, roads, avenues, lanes or alleys which have been
used by the public or accepted for maintenance by the County, in which
case proceedings for abandonment shall be brought under Article III of
Chapter 24 of this Code.
Section 2. This Act shall take effect on the 76th day following its
enactment.
