Section 13. Section 115-10, Chapter 115, title "Parking Regulations,"
of the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:

115-10. Applicability of Article.

The provisions of this Article shall be effective throughout the sub-
urban district, except in any incorporated town or special taxing area, to
the extent that such special taxing area has authority to adopt regulations
equivalent to those herein contained. If the governing body of such incor-
porated town or special taxing area lawfully adopts this Article and re-
quests the county executive to provide for the administration and enforce-
ment thereof within such town or special taxing area then the County
government may administer and enforce this Article within such town or
special taxing area.

Section 14. Severability.

The provisions of this Act are severable and if any provision, sen-
tence, clause, section or part thereof is held illegal, invalid or unconstitu-
tional or inapplicable to any person or circumstances, such illegality, in-
validity or unconstitutionality, or inapplicability shall not affect or impair
any of the remaining provisions, sentences, clauses, sections or parts of the
Act or their application to other persons or circumstances. It is hereby de-
clared to be the legislative intent that this Act would have been adopted
if such illegal, invalid or unconstitutional provision, sentence, clause, sec-
tion or part had not been included therein, and if the person or circum-
stances to which the Act or any part thereof is inapplicable had been
specifically exempted therefrom.

Section 15. Effective date.

This Act shall take effect on December 7, 1970.

An Act to amend Chapter 18, title "Police," of the Montgomery
County Code 1965, as amended, by repealing and re-enacting, with
amendments, Section 18-12, title "Recall of retired policemen in emer-
gencies," subsection (a) of Section 18-16, title "Generally," and
subsections (a), (c) and (d) of Section 18-17, title "Benefits gen-
erally"; Title II, title "Special Taxing Area Laws," Subtitle I, title
"Fire Tax Areas," Chapter 27, title "In General," by repealing and
re-enacting, with amendments, Section 27-3, title "Authority of Coun-
cil to provide for disability and death benefits for fire departments
and rescue squads," to authorize the County Executive to recall retired
policemen in the event of specified emergencies; to provide for the
County Executive depositing the monies of the Police Relief and
Retirement Fund with the approved funding agent of the Employee's
Retirement System of Montgomery County; to authorize the County
Executive to extend the active service of members of the county police
age 65 who request such extensions; to authorize the County Execu-
tive to apply for the retirement of police officers who due to disease,
illness or injury are unable to perform police duty, and to provide
recommendation and advice on the retirement of such police officers,
