Section 23. Subsection (a) of Section 2-179, Chapter 2, title "Admin-
istration," of the Montgomery County Code 1965, as amended, is hereby
repealed and re-enacted, with amendments, to read as follows:
(a) The authority to establish the general rules, regulations, and
standards for the administration of the office shall be vested in a board of
trustees except as to matters required by the Montgomery County Charter,
Public General or Public Local Law to be regulated or approved by the
county council, the county executive or the county personnel board. The
board of trustees shall be composed of nine members, each serving a term
of three years. Each trustee shall be appointed for a full term, or for the
balance of an unexpired term, by a panel (of which five members shall
be a quorum for all business of the panel) consisting of:
the Judge of the Court of Appeals for the State of Maryland from
the Third Appellate Circuit;
the Judge of the Court of Special Appeals from the Third Special
Appellate Judicial Circuit;
the Administrative Judge for the Montgomery County Circuit Court;
the Chief Judge for the Montgomery County People's Court;
the Administrative Judge of the Montgomery County People's Court
for Juvenile Causes;
the County Executive or his designee and two members of the Mont-
gomery County Bar Association designated by the Executive Com-
mittee of that Association. Said panel shall be presided over by the
Judge of the Court of Appeals from the Third Appellate Circuit (or
his designee in his absence).
Section 24. Subsection (a) of Section 2-180, Chapter 2, title "Admin-
istration," of the Montgomery County Code 1965, as amended, is hereby
repealed and re-enacted, with amendments, to read as follows:
Director; Staff; Volunteers; Operations.
(a) The county executive shall appoint, subject to the confirmation
of the county council, the director of the office of public defender upon the
recommendation of the board of trustees. The director shall appoint the
personnel of said office after recommendation of the board of trustees.
The director shall be responsible for the supervision of the legal work and
administration of said office and perform such duties as the board of
trustees may prescribe. The director shall be a member of the bar of, and
qualified to practice law in, the State of Maryland. The board and the
county executive may delegate to the director such powers of the board
and office as the said board and county executive may find to be in the
interest of good administration.
Section 25. Section 2-181, Chapter 2, title "Administration," of the
Montgomery County Code 1965, as amended, is hereby repealed and re-
enacted, with amendments, to read as follows:
2-181. Report to County Executive.
The board of trustees of the office shall, on or before November 1 of
each year, submit a report of the office to the county executive. Said report
shall include any information required by the county executive together
with all pertinent data on the operation of the office including projected
needs, a breakdown of the number and type of cases handled and relative
