Charter amendment is necessary to accomplish this.

BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF TAKOMA PARK, MARYLAND
THAT Section 49-7(1) (5) of the Montgomery County Code (1965
Edition as amended) and Section 74-9(1) (5) of the Prince George's
County Code (1963 Edition as Amended) providing for sale of bonds by
private negotiations or competitive bidding and limiting interest to be paid,
be repealed and re-enacted with amendments.
Section 1. Be it enacted by the Mayor and City Council of the City of
Takoma Park, Maryland that Section 49-7(1) (5) of the Montgomery
County Code (1965 Edition as Amended) and Section 74-9(1)(5) of the
Prince George's County Code (1963 Edition as Amended) be and they are
hereby repealed and re-enacted, with amendments, as follows:
(5) The Mayor and Council in its discretion may sell any bonds
whose issuance is authorized by this section, by private negotiation, pro-
vided the terms of such sale by private negotiation are more favorable to
the City than any of the competitive bids received. Whether such bonds are
sold upon competitive bids or by such private sale, the sale may be for less
than the par or face value of such bonds. The bonds issued shall bear
interest on the par or face value thereof at a rate approved by the Mayor
and Council.
Motion was approved by roll call vote recorded as follows: Aye:
Councilmen Eppes, Forshee, Geib, Hutmire, Nishimoto and Sidell. Nay:
none. Excused: Councilman Roth.

2. Accounts Payable—G&C Company. Councilman Forshee explained
that this is the organization from which police uniforms are purchased
and that an unbilled amount of $13,399.37 has been on the books since
1965. Even though subsequent purchases have been billed and paid, this
amount remains on the books, unbilled and unpaid, with failure on their
part to respond to queries made by City's auditors. Mr. Forshee stated
that the auditors (Hoye, Graves, Bailey & Co.) have proposed, with
Corporation Counsel Gingerich concurring, that this amount be written
off to unappropriated surplus. He moved that Council approve this action,
noting that in the event a proper bill is received in the future Council
would have to appropriate necessary funds. Motion was seconded by
Councilman Nishimoto and approved.

1. Proposed crosswalk on Maple at Sherman Avenue. Councilman
Nishimoto reported the Committee has this under consideration.
