by the Mayor with the approval of the Council. After the expiration of the
terms of the present members, the Board shall be appointed in such manner
that the terms of no more than 60% of the members of the Board expire in
any one calendar year. Any member of the Board may be removed by the
Council at any time without cause. Any vacancy in the membership of the
Board shall be filled by the Mayor with the approval of the Council.

(3)    The Mayor, with the approval of the Council may designate one
alternate member of the Board who may be empowered to sit on the Board
in the absence of any member of the Board; when the alternate is absent,
the Mayor may designate a temporary alternate.

(4)    Any person or persons, jointly or severally aggrieved by any
decision of the Board of Appeals, or any taxpayer, or any officer, depart-
ment, board, bureau of the City may appeal the same to the Circuit Court
of the County.

(5)    An appeal may be taken to the Circuit Court for Montgomery
County and from thereto the Court of Appeals of Maryland, during the
period and in the manner prescribed by rules of the Court of Appeals, from
any decision of the Board of Appeals.

k. The Council may, by resolution, adopt regulations governing the
subdivision of land, which shall be deemed to mean the division of one par-
cel of land into two or more parcels for the purpose, whether immediate or
future, of sale or development, or the combination of two or more parcels
of land into a smaller number of parcels for the purpose, whether immed-
iate or future, of sale or development.

1. All previous actions of the Planning Commission and the Board of
Appeals are hereby ratified and confirmed and all zoning regulations, and
subdivision regulations and master plans, or parts thereof, heretofore
adopted pursuant to Article 66B of the Annotated Code of Maryland by the
Mayor and Council of Gaithersburg, or the Planning Commission, are
hereby ratified and confirmed, to the extent that they have not been
specifically repealed.

22.        Every person who (a) is a citizen of the United States, (b) is at
least twenty-one years of age and (c) has had his domicile within the City
for six months next preceding any City election and (d) is registered in
accordance with this Charter, shall be a qualified voter of the City and
entitled to vote at any City election.

23.        There shall be a Board of Supervisors of Elections, consisting of
three members who shall be appointed by the Mayor with the approval of
the Council on or before the first Monday in March in every second even
numbered year. The terms of members of the Board of Supervisors of
Elections shall begin on the first Monday in March in the year in which
they are appointed and shall run for four years. Members of the Board of
Supervisors of Elections shall be qualified voters of the City and shall not
hold or be candidates for any elective office during their term of office. The
Board shall appoint one of its members as Chairman. Vacancies on the
Board shall be filled by the Mayor with the approval of the Council for the
remainder of the unexpired term. The compensation of the members of
the Board shall be determined by the Council.

24.        Any member of the Board of Supervisors of Elections may be
removed for good cause by the Council. Before removal, the member of the
Board of Supervisors of Elections to be removed shall be given a written
