2062                                Municipal Charters

provided or following a Referendum, the Mayor shall send separately, by
registered mail, to the Secretary of the State of Maryland, and to the
Department of Legislative Reference of Maryland, a complete certified
copy of the text of this Resolution, the date of the Referendum, if any is
held, and a certificate showing the number of Councilmen voting for and
against it, and a report on the votes cast for or against the amendments
hereby enacted at any referendum thereon, and the effective date of the
Charter Amendment.

This Resolution passed this 11th day of August, 1970.

The Charter Amendment enacted by the aforegoing Resolution be-
came effective this 30th day of September, 1970.

I HEREBY CERTIFY, That the aforegoing Resolution, amending the
Charter of the City of Cumberland, Maryland, was passed this 11th
day of August, 1970, with four votes in the affirmative and no votes in the
negative.

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of Charter Amendment Resolution No. 49, passed by the Mayor and City
Council of Cumberland, Maryland, in Regular Session on August 11, 1970.

I FURTHER CERTIFY, That there was no Petition for a Referendum
on the proposed amendment filed within the required time and, therefore,
the same became effective on September 30, 1970.

Charter Amendment
Resolution No. 50

RESOLUTION of the Mayor and City Council of Cumberland,
Maryland, adopted in pursuance of the authority contained in Article
11-E of the Constitution of the State of Maryland, and Section 13 of
Article 23A of the Annotated Code of Maryland, entitled "Municipal
Corporations," as said Section was enacted by Chapter 423 of the Acts
of the General Assembly of Maryland, 1955, entitled "A RESOLU-
TION TO AMEND THE CHARTER OF THE CITY OF CUMBER-
LAND, MARYLAND (1966 EDITION), BY REPEALING AND
REENACTING, WITH AMENDMENTS, SECTION 28 OF SAID
CHARTER, FOUND UNDER THE SUBTITLE 'MAYOR AND
COUNCIL', AND DEALING WITH THE DUTIES, ETC., OF THE
COMMISSIONER OF FINANCE."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, MARYLAND, That Section 28 of the Charter
of the City of Cumberland (1966 EDITION), as enacted by Charter
Amendment Resolution No. 40, passed November 4, 1968, be and is hereby
repealed and reenacted, with amendments, to read as follows:
