11-E of the Constitution of the State of Maryland, and Section 13 of
Article 23A of the Annotated Code of Maryland, entitled "Munici-
pal Corporations," as said Section was enacted by Chapter 423 of the
Acts of the General Assembly of Maryland, 1955, entitled "A RESO-
LUTION TO AMEND THE CHARTER OF THE CITY OF CUM-
BERLAND, MARYLAND (1966 EDITION), BY REPEALING AND
REENACTING, WITH AMENDMENTS, SECTION 43 OF SAID
CHARTER, FOUND UNDER THE SUBTITLE 'CIVIL SERVICE-
FIRE AND POLICE', AND PERTAINING TO APPOINTMENTS
TO POSITIONS IN CLASSIFIED SERVICE, PROBATIONARY
PERIOD AND TEMPORARY APPOINTMENTS."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That Section 43 of the Charter of the City of
Cumberland (1966 Edition) be and is hereby repealed and reenacted, with
amendments, to read as follows:

"When a vacancy occurs or a new position is created in the classified
service, the appointing officer shall fill such position provisionally by the
appointment of one of the persons certified to him by the commission as
above provided, which appointee shall be on probation for a period of
[one year] six months. At or before the expiration of the period of proba-
tion, the head of the department or office in which such candidate is
employed may, in the exercise of his discretion, remove the said probationer.
Unless so removed during the probationary period, his appointment shall
be deemed complete. Where an emergency arises or the services to be
rendered are only for a temporary period, not to exceed sixty days, the
appointing officer may, with the approval of the commission, make a
temporary appointment to remain in force not exceeding sixty days, and
only until a regular appointment under the provisions of this subtitle
can be made."

Section 2. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is August 11, 1970, and the amendment to
the Charter of the City of Cumberland hereby enacted, shall become
effective on September 30, 1970, unless a proper Petition for a Referendum
hereon shall be filed as provided by Section 13 of Article 23A of the
Annotated Code of Maryland, and provided a complete and exact copy of
this Resolution shall be continuously posted on the North Centre Street
entrance of the City Hall, Cumberland, Maryland, until September 20, 1970,
and provided further that a fair summary of the proposed amendments
shall be published in the Cumberland Evening Times, a newspaper of
general circulation in the City of Cumberland, once in each of the
weeks of Aug. 10, 17, 24, 31 and Sept. 7, 1970.

Section 3. AND BE IT FURTHER RESOLVED, That the Mayor of
the City of Cumberland is hereby specifically directed to carry out the
provisions of Section 2 hereof, regarding the giving of notice by posting
and publication of this Resolution approving the same, and, as evidence
of said compliance, the City Clerk shall cause to be affixed hereto a certifi-
cate of publication of the newspaper in which the summary of this
Resolution shall have been published, and the Mayor, if there is no Petition
for a Referendum, shall declare the Charter Amendment made to be
effective on the effective date herein provided for, which is September 30,
1970, by affixing his signature hereto in the space provided below the
effective date hereof.

Section 4. AND BE IT FURTHER RESOLVED, That as soon as the
Charter amendment hereby made shall become effective, either as herein
