2050                                Municipal Charters

Section 5. AND BE IT FURTHER RESOLVED, That as soon as
the Charter Amendment hereby made shall become effective, either as
herein provided or following a Referendum, the Mayor shall send sepa-
rately, by registered mail, to the Secretary of the State of Maryland, and
to the Department of Legislative Reference of Maryland, a complete
certified copy of the text of this Resolution, the date of the Referendum,
if any is held, a certificate showing the number of Councilmen voting for
and against it, and a Report on the votes cast for or against the amendment
hereby enacted at any Referendum thereon, and the effective date of the
Charter Amendment.

This Resolution passed this 30th day of December, 1969.

The Charter amendment enacted by the aforegoing Resolution became
effective this 18th day of February, 1970.

I HEREBY CERTIFY, That the aforegoing Resolution, amending
the Charter of the City of Cumberland, Maryland, was passed this 30th
day of December, 1969, with 5 votes in the affirmative and -0- votes in the
negative.

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of the Charter Amendment Resolution No. 43, passed by the Mayor and
City Council of Cumberland, Maryland, in Regular Session on December
30,1969.

I FURTHER CERTIFY, That there was no Petition for a Referendum
on the proposed amendment filed within the required time and, therefore,
the same became effective on February 18, 1970.

Charter Amendment
Resolution No. 44

A Resolution of the Mayor and City Council of Cumberland, Mary-
land, adopted pursuant to the authority contained in Article 11-E of
the Constitution of the State of Maryland, and Section 13 of Article
23A of the Annotated Code of Maryland, entitled "Municipal Cor-
porations," as said Section was enacted by Chapter 423 of the Acts of
the General Assembly of Maryland, 1955, entitled "A RESOLUTION
TO AMEND THE CHARTER OF THE CITY OF CUMBERLAND,
MARYLAND (1966 EDITION), BY REPEALING AND RE-
ENACTING, WITH AMENDMENTS, SECTION 18 OF SAID
CHARTER, FOUND UNDER THE SUBTITLE 'MAYOR AND
COUNCIL', DESIGNATING COUNCILMEN AS COMMISSIONERS
OF DEPARTMENTS OF CITY GOVERNMENT."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That Section 18 of the Charter of the City of
