Marvin Mandel, Governor 203 4 (a) To allot all or any portion of the funds herein appropriated 5 to the various departments, boards, commissions, officers, schools and 6 institutions by monthly, quarterly or seasonal periods and by objects 7 of expense and may place any funds appropriated but not allotted in 8 contingency reserve available for subsequent allotment. Upon his 9 own initiative or upon the request of the head of any State agency, 10 the Secretary may authorize a change in the amount of funds so 11 allotted. The Secretary shall before the beginning of the fiscal year 12 file with the Comptroller of the Treasury his schedule of allotments, 13 if any. The Comptroller shall not authorize any expenditure or 14 obligation in excess of the allotment made and any expenditure so 15 made shall be illegal. 16 (b) To fix the number and classes of positions or man years of 17 authorized employment for each agency, unit or program thereof, 18 not inconsistent with the Public General Laws in regard to classi- 19 fication of positions. He shall file his determinations with the Secre- 20 tary of Personnel and the Comptroller of the Treasury before the 21 beginning of the fiscal year and no payment for salaries or wages 22 nor any request for or certification of personnel shall be made except 23 in accordance with the Secretary's determinations. At any time dur- 24 ing the fiscal year the Secretary may amend the number and classes 25 of positions of man years of employment previously fixed by him. 26 (c) To prescribe procedures and forms for carrying out the 27 above provisions. 1 Sec. 3. And be it further enacted, That no officer, agent or em- 2 ployee of the State or of any department, bureau or agency of the 3 State, and no member of any commission or board of the State who 4 receives remuneration of any kind which is appropriated by this 5 budget shall, during the time he receives or is entitled to receive 6 such remuneration, or who is on leave from any such department, 7 bureau, agency, commission or board of the State, promote or oppose, 8 in any manner, directly or indirectly, the passage by the General 9 Assembly of any legislation, or act in any manner as a legislative 10 agent, lobbyist or counsel before any legislative committee, or other- 11 wise; this restriction shall not apply to legislation directly involving 12 or affecting the department, bureau, agency, commission or board of 13 the State with which the officer, agent, or employee is connected or 14 by whom he is employed, nor shall this restriction apply to any 15 representative of an employees' organization or association who has 16 been duly authorized as a representative of the organization or asso- 17 ciation to promote the Legislative program of the organization or 18 association. No employee of the State or of any department, bureau, 19 agency, commission or board of the State shall in any event, appear 20 or act as a legislative agent, lobbyist or counsel without the express 21 approval of the head of the department, bureau, agency, commission 22 or board by whom he is employed; provided, however that the pro- 23 visions of this section shall not prevent the appearance and testi- 24 mony before any committee or group of members of the General 25 Assembly of an officer, agent or employee of the State or of any 26 department, bureau or agency of the State or any member of any 27 commission or board of the State upon the specific request of a 28 member of the General Assembly. 1 Sec. 4.
