CA-2—Resolution of December 8, 1969

Resolution of the Mayor and Aldermen of the City of Annapolis
adopted pursuant to the authority of Article 11-E of the Constitution
of the State of Maryland (1966 Edition), title "Corporations
Municipal," to add one (1) new section to be designated Section 97 to
the Charter of the City of Annapolis (1960 Edition) to follow immedi-
ately after Section 96 thereof and to be entitled "Licensing and Regu-
lation of Peddlers and Hucksters" in order to empower the Mayor
and Aldermen of the City of Annapolis to license, regulate, tax, re-
strict and prohibit Peddlers, Hucksters and itinerant dealers and
matters relating generally.

SECTION I. BE IT ESTABLISHED AND ORDAINED BY THE
MAYOR AND ALDERMEN OF THE CITY OF ANNAPOLIS that one
(1) new section and a new subheading "Licensing and Regulation of Ped-
dlers and Hucksters," be and it is hereby added to the Charter of the City
of Annapolis to read as follows:

Section 97. Licensing and Regulation of Peddlers and Hucksters.

The Mayor and Aldermen of the City of Annapolis are hereby author-
ized and empowered to enact ordinances to license, tax, regulate, suppress,
limit the number of, restrict to certain districts of the City and to certain
hours and prohibit peddlers, hucksters, hawkers, and itinerant dealers and
all other persons selling any articles, goods, wares, merchandise, food
products or personal property of any nature on the streets, alleys and ways
of the City, and to revoke such licenses for any action or threat of action
by such a licensee in the course of his occupation which causes or threatens
harm or injury to inhabitants of the City or to their welfare or happiness.

SECTION II. AND BE IT FURTHER RESOLVED by the Mayor
and Aldermen of the City of Annapolis that the date of adoption of this
Resolution, is 8th day of December, 1969, and the Amendment of the Char-
ter of the City of Annapolis hereby enacted shall become effective on 28th
day of January, 1970, unless a proper petition for a referendum hereon
shall be filed as permitted by law, provided a complete and exact copy of
this Resolution shall be continuously posted on the bulletin board in the
City Hall, until 18th day of January, 1970, and provided further that a
copy of the title of this Resolution shall be published in the "Evening
Capital," a newspaper of general circulation in the City of Annapolis, or
in any other newspaper of such general circulation, once in each of the
weeks, December 15, 1969, December 22, 1969, December 29, 1969, Janu-
ary 5, 1970, and January 12, 1970.

SECTION III. AND BE IT FURTHER RESOLVED that the Mayor
is hereby specifically enjoined to carry out the provisions of Section II
hereof, and, as evidence of such compliance, the Mayor shall cause to be
affixed to the minutes of this meeting appropriate certificates of publica-
tion of the newspaper or newspapers in which the title of this Resolution
shall have been published and shall declare the Charter Amendment hereby
enacted to be effective either on January 28, 1970 or following a favorable
referendum thereon, by affixing his signature hereto in the space provided
on the effective date of such amendment.

SECTION IV. AND BE IT FURTHER RESOLVED that as soon as
the Charter amendment hereby enacted shall become effective, either as
herein provided or following a referendum, the Mayor shall send sepa-
rately by registered mail, to the Secretary of State of Maryland and to
