CHAPTER 761

(Senate Bill 421)

AN ACT to repeal and re-enact, with amendments, Sections 3 (c)
and 3 (g) of Article 59 of the Annotated Code of Maryland (1970
Supplement), title "Mental Hygiene," subtitle "Short Title, State-
ment of Policy and Definitions"; to add new Sections 3 (d-1), 3
(e-1), 3 (e-2), 3 (h-1), 3 (h-2) and 3 (i-1) to Article 59 of the
Code, same title and subtitle, to follow immediately after Sections
3 (d), 3 (e), 3 (h) and 3 (i)
respectively; to repeal and re-enact,
with amendments, Sections 11(c), 11 (f), 11 (g), 16, 18 (a), 18

(b), 18 (c), 19 and 20 of Article 59, same title, subtitle, "Admis-

sions, Release and Transfer," and to repeal Sections 11 (d) and
11 (e) of the same Article, title and subtitle; to add new Sections

22, 22A, 22B and 22C to Article 59 of the Code, same title and

subtitle, to follow immediately after Section 21 thereof; to repeal

Sections 12, 13, 14, 15 and 21 of Article 59 of the Code, same
title and subtitle and to enact new Sections 12, 13, 14, 15 and 21

in lieu thereof, to stand in the place of the sections repealed; to
repeal and re-enact, with amendments, Sections 24 (a) and 27 of

Article 59 of the Code, same title, subtitle "Insanity as a Defense

in Criminal Cases"; to repeal and re-enact, with amendments,

Sections 50 (c) and 50 (d) of Article 59 of the Code, same title,

subtitle "Patients' Rights"; to add new Sections 50 (e), 50 (f)

and 50 (g) to Article 59 of the Code, same title and subtitle, to

follow immediately after Section 50 (d) thereof; to repeal Section

51 of Article 59 of the Code, same title and subtitle, and to enact

new Section 51 in lieu thereof, to stand in the place of the section
repealed; and
ADD NEW SECTION 22 TO ARTICLE 59 OF
THE ANNOTATED CODE OF MARYLAND (1970 SUPPLE-
MENT), TITLE "MENTAL HYGIENE," TO FOLLOW IMME-
DIATELY AFTER SECTION 21 THEREOF AND TO BE
UNDER THE NEW SUBTITLE ''EMERGENCY ADMISSIONS";
to add new Sections 53, 54, 54A and 55 , 56 AND 57 to Article 59
of the Code, same title, to follow immediately after Section 52
thereof and to be under the new subtitle "Mental Health Infor-
mation AND REVIEW Service," to provide for certain definitions
and to eliminate certain others; to provide a procedure for the
admission or detention of a person for emergency psychiatric
care and treatment AND GENERALLY RELATING THERETO;
to provide a procedure for judicial commitment; to provide for a
review board to renew admission and retention of patients in men-
tal hospitals; to
provide a procedure to determine judicially mental
incompetency and the need for
hospitalization; to provide for cer-
tain penalties in relation to certain violations; to provide for the
creation and duties of a Mental Health Information AND RE-
VIEW Service; and relating generally to the rights of patients
detained in mental facilities under the provisions of this Act, and
making corrections therein.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 3 (c) and 3 (g) of Article 59 of the Annotated Code
of Maryland (1970 Supplement), title "Mental Hygiene," subtitle
"Short Title, Statement of
Policy and Definitions," be and they are
hereby repealed and re enacted, with amendments; that new Sections
3 (d-1), 3 (e-1), 3(e-2), 3 (h-1), 3 (h-2) and 3 (i-1) be and they
