AN ACT to repeal and re-enact, with amendments, Section 19(1-1)
of Article 2B of the Annotated Code of Maryland (1970 Supple-
ment), title "Alcoholic Beverages," subtitle "Beer, Wine and
Liquor Licenses," AND TO REPEAL AND RE-ENACT, WITH
AMENDMENTS, SECTION 105A OF SAID ARTICLE (1970
SUPPLEMENT), SUBTITLE "HOURS AND DAYS FOR
SALE," to provide that a certain alcoholic beverage license in
Wicomico County permits sales at bars or counters to seated
patrons, PROVIDING FOR THE SUNDAY HOURS APPLICA-
BLE TO THESE LICENSEES, and correcting an error therein.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 19(1-1) of Article 2B of the Annotated Code of Mary-
land (1970 Supplement), title "Alcoholic Beverages," subtitle "Beer,
Wine and Liquor Licenses," be and it is AND SECTION 105A OF
SAID ARTICLE (1970 SUPPLEMENT), SUBTITLE "HOURS
AND DAYS FOR SALE" BE AND THEY ARE hereby repealed
and re-enacted, with amendments, to read as follows:
19.
(1-1) (1) In Wicomico County the annual fee for such a license
shall be one thousand dollars ($1,000) for a restaurant and fifteen
hundred dollars ($1,500) for a hotel.
(2) Such a license may be issued in Wicomico County to a bona
fide hotel which (i) is an establishment for the accommodation of
the public providing services ordinarily found in hotels, (ii) is
equipped with not fewer than twenty-five rooms, a lobby with regis-
tration and mail desk and seating facilities and a dining room which
serves full-course meals at least twice daily. This license in a hotel
does not permit sales [at bars or counters, nor] for consumption off
the premises.
(3) Such a license may be issued in Wicomico County to a res-
taurant which meets the following requirements and conditions: (i)
serves full-course meals at least twice daily; (ii) has a regular seat-
ing capacity at tables (not including seats at bars or counters) for
seventy-five or more persons; (iii) serves alcoholic beverages only
during or in connection with meals, with patrons seated at tables
and not OR at bars or counters; (iv) during the effective period of the
license has daily average receipts from the sale of food in excess of
those for the sale of alcoholic [bverages] beverages; (v) has an
applicant or applicants for the license who has or have been a bona
fide resident or residents of Wicomico County for not less than five
years immediately preceding the filing of the application, and who
