of the Secretary of Transportation and under the provisions of Section
8 of Article 15A may, in any fiscal year, [allocated] allocate from the
Transportation Trust Fund to a "Municipality-Urban Area Highway
Construction Fund," which is hereby established, a sum equal to such
amount of federal-aid urban highway funds that may become available
from the Bureau of Public Roads and that may be allocated by the
State Roads Commission to the several municipalities and urban
areas and that may subsequently be released by such municipalities
and urban areas to the State Roads Commission for use on the State
highway system. Such Municipality-Urban Area Highway Construc-
tion Fund shall be subject to apportionment by the State Roads
Commission and matching construction funds shall be required of
each such municipality and urban area participating in such program.
Such Municipality-Urban Area Highway Construction Fund and
such matching funds shall be expended only for highway construction
and reconstruction projects under such rules and regulations as the
Commission shall determine.

(f) No distribution as provided in this section shall be made
to any county or municipality, however, unless it shall have levied,
in its current fiscal year, taxes sufficient to collect a minimum of one
dollar per capita in revenue and unless it shall have certified a copy
of said levy to the State Comptroller; and provided further, that
any moneys, otherwise distributable under this section, which shall
not be distributed at the close of the fiscal year of said county or
municipality because of failure of said county or municipality to make
such levy or certification, shall revert to the Transportation Trust
Fund. Per capita revenue shall be computed for purposes of this
section by using the population figures furnished by the latest federal
census, or by an official local censes CENSUS, whichever is latest.

(d) Preparation of contract plans and specifications; estimates;
supervision of construction; inspection of workmanship and materials;
mill and [ship] shop inspection; tests of materials; control surveys;
traveling, transportation and subsistence; expenses of engineers as-
signed to the design preparation of contract plans and specifications;
surveys, supervision of construction and inspection of construction
work.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
