mine if such applicant comes within the provisions of this section.
The application and the action taken thereon by the police com-
missioner shall be a public record. When the police commissioner

issues said permit, he shall receive a fee of fifty cents (50¢) to

cover the cost of the issuance of said permit; provided, however,
ISSUES SAID PERMIT, HE SHALL RECEIVE A FEE OF NOT
IN EXCESS OF TEN DOLLARS ($10.00) TO COVER THE COSTS
OF ADMINISTRATION OF THIS PROVISION; PROVIDED,
HOWEVER, that no such permits shall be issued for the playing of
the game of bingo in any regular restaurant or tavern where alco-
holic beverages are sold or in any permanent place of amusement
or entertainment. Provided, that nothing herein contained shall be
construed to permit the playing of said games on Sunday; and
provided further that the provisions of this section shall apply
only to Baltimore City.

     Sec. 2. And be it further enacted, That this Act shall take

effect July 1, 1971.

SEC. 2. AND BE IT FURTHER ENACTED, THAT A NEW
SECTION 405 (G) BE AND IT IS HEREBY ADDED TO
ARTICLE 81 OF THE ANNOTATED CODE OF MARYLAND
(1969 REPLACEMENT VOLUME, 1970 SUPPLEMENT) TITLE
"REVENUE AND TAXES," SUBTITLE "ADMISSIONS AND
AMUSEMENT TAX" TO FOLLOW IMMEDIATELY AFTER
SECTION 405 (F) THEREOF, TO READ AS FOLLOWS:

(G) PROVIDED, HOWEVER, THAT NOTWITHSTANDING
THE PROVISIONS OF SUBSECTION (A) OF THIS SECTION 405
THE EXEMPTION FROM THE ADMISSIONS AND AMUSE-
MENT TAX SHALL NOT APPLY TO GROSS RECEIPTS DE-
RIVED FROM THE AMOUNTS CHARGED FOR ADMISSION
AND THE USE OF SPORTING OR RECREATIONAL FACIL-
ITIES OR EQUIPMENT COMMONLY DESCRIBED AS "BINGO"
WHEN SUCH BINGO GAMES ARE OPERATED PURSUANT
TO SECTION 260 OF ARTICLE 27; PROVIDED HOWEVER
THAT NO ADMISSIONS AND AMUSEMENT TAX SHALL
APPLY TO ANY SUCH GROSS RECEIPTS WHEN THE NET
PROCEEDS OF SUCH BINGO GAMES ARE USED EXCLU-
SIVELY FOR ELEMENTARY OR SECONDARY EDUCATION.

SEC. 3. AND BE IT FURTHER ENACTED, THAT THIS ACT
SHALL TAKE EFFECT JULY 1, 1971.

Article 21 of the Annotated Code of Maryland (1970 Supplement),
title "Conveyancing," subtitle "Express and Implied Warranties,"
to clarify the definition of "improvements."
