WRITING TO THE GOVERNOR NOT LATER THAN TEN (10)
DAYS AFTER RECEIPT OF THE NOTICE. IN THE EVENT OR
REMOVAL THE GOVERNOR SHALL PROMPTLY APPOINT A
SUCCESSOR.
Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate pres-
ervation of the public health and safety and having been passed
by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, the same
shall take effect from the date of its passage SHALL TAKE EF-
FECT JULY 1, 1971.

AN ACT to repeal and re-enact, with amendments, Section
412(c) 425 of Article 81 of the Annotated Code of Maryland (1969
Replacement Volume), title "Revenue and Taxes," subtitle "Road
Tax on Motor Carriers," providing that the term "motor carrier"
does not mean registered dealers in new commercial motor vehicles
who are on the highway solely to road test the vehicle EXEMPT-
ING COMMERCIAL VEHICLES BEING ROAD TESTED FROM
THE PROVISIONS OF THE ROAD TAX ON MOTOR CAR-
RIERS.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 412(c) 425 of Article 81 of the Annotated Code of
Maryland (1969 Replacement Volume), title "Revenue and Taxes,"
subtitle "Road Tax on Motor Carriers," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:
412.
(c) The term "motor carrier" means any person who operates or
causes to be operated any commercial motor vehicle on any highway
in this State [.]; provided, however, that this shall not be construed
to include registered dealers in new commercial motor vehicles who
are on the highway solely for the purpose of road testing the vehicle.
425.
(A) NOTHING IN THE SUBTITLE SHALL APPLY TO ANY
COMMERCIAL VEHICLE OR VEHICLES OPERATED BY THE
STATE OR ANY SUBDIVISION THEREOF, THE UNITED
STATES OR ANY AGENCY OF TWO OR MORE STATES OR
OF STATES AND THE UNITED STATES IN WHICH THIS
STATE PARTICIPATES, OR TO ANY SCHOOL BUS AS DE-
FINED BY THE LAWS OF THIS STATE OPERATED BY, FOR
OR ON BEHALF OF A STATE, ANY SUBDIVISION THEREOF,
OR ANY PRIVATE OR PRIVATELY OPERATED SCHOOL OR
SCHOOLS.
