sirable. The Advisory Commission shall submit an annual report to
the Secretary and the Legislature regarding rules, regulations, and
programs relating to this Act.

The Secretary shall enforce the provisions of this Act and the
rules and regulations pursuant hereto. Any person who violates any
provisions of the Act or any rule or regulation pursuant hereto is
guilty of a misdemeanor, and upon conviction for each offense he
shall be fined not more than one thousand dollars. The Secretary,
upon information, may refer any apparent violation to the appro-
priate State's Attorney.
Sec. 2. And be it further enacted, That if any provision of this
Act or the application thereof to any person or circumstance is held
invalid for any reason, the invalidity shall not affect the other pro-
visions or any other application of this Act which can be given effect
without the invalid provisions or application, and to this end all the
provisions of this Act are declared to be severable.
Sec. 3. And be it further enacted, That all laws or parts of laws,
public general or public local, inconsistent with the provisions of this
Act are repealed to the extent of the inconsistency.
Sec. 4. And be it further enacted, That this Act shall take effect
July 1, 1971.

AN ACT to add new Section 257-J to Article 41 of the Annotated
Code of Maryland (1965 Replacement Volume and 1970 Supple-
ment), title "Governor—Executive and Administrative Depart-
ments," subtitle "Department of Economic and Community Devel-
opment," to follow immediately after Section 257-1 thereof; to
authorize the Department of Economic and Community Develop-
ment to prepare and issue a Model Performance Code for building
construction in the State of Maryland; to provide what elements
shall be covered by said Code and how it shall be framed; to set
forth the circumstances under which said Code shall be binding
on different subdivisions within the State; to set out the respon-
sibilities and duties of the Department of Economic and Com-
munity Development in connection with the enforcement and ad-
ministration of said Code; and relating generally to a Model Per-
formance Code for building construction.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 257-J be and it is hereby added to Article 41 of the
