(2) Any industrialized building which does not carry the insignia
of the Department is subject to control of any local governing body
in this State within whose jurisdiction it is to be installed. When
such a building is offered for sale, the person to whom the building
is offered for sale must be specifically advised by the seller or manu-
facturer that the building does not carry State certification.

(8) Notwithstanding any other provision of this Act, local land
use requirements, building setback requirements, side and rear yard
requirements, site development and property line requirements, zon-
ing requirements and uniform fire control regulations, regardless
of where requirements, ordinances, regulations or statutes are set
forth, remain reserved to city and county government.

(d)  Any alteration or modification or attempted use of the unit
or mobile home beyond the scope of the certification shall result in
forfeiture of the certification and insignia unless approval for the
modification or use beyond that listed in the certification shall be
secured from the Department in advance.

(e)  Any issuance or denial of a certification or modification thereof
shall be made by the Department. The Department's Board of Review
shall have power to review such determinations. Local enforcement
agency representatives, manufacturers, and installers of industrial-
ized buildings and mobile homes may seek review by the Department
of the grant or denial of a certification and shall also be empowered
to report any buildings or mobile homes that may have been damaged
en route to the site to the Department so that the Department may
arrange for a reinspection of the building or mobile home. The fee
for this reinspection may be charged to the installer.

(f)   The Department shall establish a schedule of fees for admin-
istration of the inspection and certification program for both indus-
trialized buildings and mobile homes. To the extent possible, the
fees will be based on the cost of administration of these programs
and the payments of the fees shall be included in the funds of the
Department. Any funds unexpended at the end of the fiscal year shall
not revert but instead, shall be maintained in a special fund avail-
able to the Department for carrying out the purposes of this Act.

266EE-5. Advisory Commission on Industrialized Building and
Mobile Homes.

(a)  In carrying out his duties under this Act, the Secretary shall
have the assistance of an Advisory Commission on Industrialized
Building and Mobile Homes, which is hereby created. Members of the
Advisory Commission shall be appointed by the Secretary and shall
serve without compensation. Members appointed, shall be broadly
representative of the industries and professions involved in the de-
velopment and construction of industrialized buildings and mobile
homes and shall also include representatives from building code en-
forcement agencies, architectural and engineering associations, build-
ing construction trades, the contracting and manufacturing indus-
tries, legislative bodies of local government, the financial industry
and the general public.

(b)   The Advisory Commission shall make recommendations to
the Secretary regarding the rules and regulations as promulgated
under this Act as it shall from time to time deem necessary or de-
